INTRODUCTION:

The Solid Waste Section of the Waste Management and Radiological Protection Division (WMRPD), within the Michigan Department of Environmental Quality (MDEQ), has responsibility for issuing electronic equipment manufacturer registrations under the authority of Part 173, Electronics of the Natural Resources and Environmental Protection Act, 1994 PA 451, as amended (Act 451).  The purpose of this registration is to support a manufacturer's electronic device takeback program.

Natural Resources and Environmental Protection Act, 1994 PA 451, as amended; Part 173 (Electronics)

C.  APPLICABLE REGULATION:

No rules have been promulgated to support this program.

D.  SUMMARY OF PERMIT/APPROVAL PROCESS:

1.  Applicability

This program applies to manufacturers of covered electronic devices.

  • Computers, laptops, televisions, monitors, printers and tablets.

            2.  General Requirements

Manufacturers who are selling new covered electronic devices in Michigan are required to: 

  • Register with the Department of Environmental Quality
  • Arrange an electronic recycling (takeback) program-free and convenient for households and small businesses (less than 10 employees)
  • Maintain a Web site and otherwise inform consumers how to recycle TVs and computers
  • Submit annual information about their takeback program (number of units collected, names of collection or recycling agencies involved)

Retailers are required to: 

  • Sell ONLY new computers and TVs produced by registered manufacturers
  • A retailer may not offer for sale a covered electronic device in the state of Michigan per Section 17303 unless the brand owner of the device is in compliance with the requirements of Act 451, Part 173, Electronics.

Covered electronic devices include desktop computers, laptop computers, monitors, tablets, televisions and printers.

Recyclers of TVs and computers are required to: 

  • Register with the Department of Environmental Quality 
  • Comply with federal and state recycling laws 
  • Annually report the amount of recycled material and the names and locations of recycling facilities under their direct control in Michigan who processed the recycled equipment.

The WMRPD reviews for administrative completeness and technical adequacy; verifies receipt of registration fee and, if adequate, the registration acceptance letter is emailed to the applicant.

            5.  Operations Requirements

Permittee must comply with statute, listed above.

            6.  Fees

$3,000 registration fee is required for this program.

            7.  Appeal Process

No contested case provision so if dispute arises it will be filed in Circuit Court.

            8.  Public Input Opportunities

Comments are always welcome and bi-annual report is generated and posted on the website.
