Operating License Amendment 8

On March 23, 2017, the Michigan Department of Environmental Quality (DEQ), Waste Management and Radiological Protection Division approved a minor modification to the License for the replacement of Storage Tank System V-402 in the 32 Incinerator tank farm.  Dow may implement the partial closure of the old Tank V-402 under the approved partial closure plan, below.  Dow may install the new, replacement Tank V-402 without prior written approval from the DEQ.  The Dow partial closure plan and installation plans, and DEQ minor modification approval letter for Amendment 8 to the facility operating license are provided below.

Operating License Amendment 7

On July 21, 2016, the Michigan Department of Environmental Quality, Office of Waste Management and Radiological Protection approved a Revised Corrective Action Report, Midland Area Soils, received from the Dow Chemical Company on May 6, 2016.  Pursuant to Condition XI.B.2 of the License, the approved Report became an enforceable condition of, and Attachment 18 to, the License upon approval.  Additional information regarding the review and approval of the Report is posted on the DEQ Web Page under Dioxin Information, Midland Area Soils Corrective Action.

Operating License Amendment 6

On October 17, 2016, and October 21, 2016, the Michigan Department of Environmental Quality, Office of Waste Management and Radiological Protection accepted minor modifications to the facility operating license based on notifications from Dow of its intent to replace existing piezometer 3285 in the Facility Shallow Groundwater Hydraulic Monitoring Program, Monitoring Well 2908 in the Poseyville Landfill Groundwater Monitoring Program, and Piezometer 2922, in the Poseyville Landfill Corrective Action Hydraulic Monitoring Program in Part IX of the operating license renewal issued September 25, 2015.  Dow may implement these minor operating license modifications without prior written approval from the MDEQ.  The minor modification notifications and acceptance emails for Amendment 6 to the facility operating license are provided below.

Operating License Amendment 5

On October 4, 2016, the Michigan Department of Environmental Quality, Office of Waste Management and Radiological Protection approved a minor modification to the facility operating license for the Salzburg Landfill based on a review of updated closure and postclosure plans and cost estimates templates received from The Dow Chemical Company (Dow) on July 8, 2016, via email, pursuant to the operating license renewal issued September 25, 2015.  The request and approval letter for Amendment 5 to the facility operating license are provided below.  The updated closure and postclosure plans template replaces the previous License Attachment 6.

Operating License Amendment 4

As-Built Updates:

On January 26, 2017, the following parts of Attachment 8 to the license were updated based on the submission of as-built information pursuant to the June 3, 2016, minor license modification approval.

Attachment 8 Text:

  • Page 4 description of the setup/layout of the WSA I container storage area and associated repagination to accommodate new text were updated.
  • Text and Appendix A were updated to include a reference to two new as-built drawings B2-011-140633 and B2-012-140633

Attachment 8 Drawings:

  • Drawing B2‐102‐927122 was replaced with the updated, as-built drawing B2‐102‐927122, Rev. L.
  • As-built drawings B2‐011‐140633 and B2‐012‐140633 were added.

A fully-updated copy of Attachment 8 is included in the Final License Attachments list below.  The previous Attachment 8 issued with the September 15, 2015, operating license has been removed, and is available upon request by contacting Dan Dailey.

Amendment 4 Previous Approval

On June 3, 2016, the Michigan Department of Environmental Quality, Office of Waste Management and Radiological Protection approved a minor modification to the facility operating license for the Midland Plant based on a request for Waste Storage Area I (WSAI) Dike Concrete Replacement received from The Dow Chemical Company (Dow) on March 17, 2016, via email, pursuant to the operating license renewal issued September 25, 2015.  The request and approval letter for Amendment 4 to the facility operating license are provided below.

Operating License Amendment 3

On May 19, 2016, the Michigan Department of Environmental Quality, Office of Waste Management and Radiological Protection approved a minor modification to the facility operating license based on a design submittal for final closure capping of Salzburg Landfill Cells 20 – 22 by Dow on February 11, 2016, and updated on February 17, 2016, April 7, 2016, and May 10, 2016 (collectively, the Design Submittal) pursuant to the operating license renewal issued September 25, 2015.  The Design Submittal and approval letter for Amendment 3 to the facility operating license are provided below.

Operating License Amendment 2

On May 12, 2016, the Michigan Department of Environmental Quality, Office of Waste Management and Radiological Protection approved a minor modification to the facility operating license based on a request from Dow to replace existing piezometer 3391 in the Facility Shallow Groundwater Hydraulic Monitoring Program in Part IX of the operating license renewal issued September 25, 2015.  The minor modification request and approval letter for Amendment 2 to the facility operating license are provided below.

Operating License Amendment 1

On January 26, 2016, the Michigan Department of Environmental Quality, Office of Waste Management and Radiological Protection approved minor modifications to the facility operating license to update administrative and informational changes to the contingency plan and personnel training attachments, and to update the Part A and Topographic maps for Salzburg Landfill pursuant to the Schedule of Compliance in Part XII of the operating license renewal issued September 25, 2015.  The transmittal letter and summary of changes documents for Amendment 1 to the facility operating license are provided below.

Issuance of Hazardous Waste Management Facility Operating License Renewal License for the Dow Michigan Operations, Midland Plant and Salzburg Landfill

On September 25, 2015, the Department of Environmental Quality, Office of Waste Management and Radiological Protection (OWMRP) issued the hazardous waste management facility renewal operating license to The Dow Chemical Company (Dow) for its Michigan Operations, Midland Plant and Salzburg Landfill facilities pursuant to Part 111, Hazardous Waste Management, of the Natural Resources and Environmental Protection Act, 1994 PA 451, as amended. The License will allow the continued operation of Dow's container storage, tank storage and treatment, surface impoundment treatment/storage/disposal, incineration, post-closure, landfilling, and on-site and off-site corrective action activities.

In addition, on September 25, 2015, the OWMRP approved Dow's proposed Site-Specific Land Disposal Restrictions (LDR) Treatability Variance (Variance) and incorporated it into the License as part of the Waste Analysis Plan and to extend the term of the Variance so that it will run concurrent with the License and be renewed as part of future licensing actions. The revised Variance applies to certain soils generated during corrective action or as a result of upgrade or maintenance of corrective action management systems, including Dow's Revetment Groundwater Interception System, and adds non-routinely generated Tertiary Pond Solids as a waste stream subject to the Variance.

Revised Dow Site-Specific LDR Treatability Variance Approval - September 25, 2015

Licensing documents are kept on the DEQ website for six months, or as long as they continue to contain conditions that actively apply to the facility.  After six months or when no longer active, whichever is longer, documents are considered historical and removed from the DEQ website.  Historical documents removed from the DEQ website are still available and may be obtained by contacting Dan Dailey using the information specified above.
