EXECUTIVE DIRECTIVE NO. 2005-7
TEMPORARY WAIVER OF ENFORCEMENT PENALTIES FOR TRANSPORTATION OF MANUFACTURED HOUSING
WHEREAS, Section 1 of Article V of the Michigan Constitution of 1963 vests the executive power of the State of Michigan in the Governor;
WHEREAS, the destruction caused by Hurricane Katrina in the Gulf Coast region has resulted in numerous fatalities, injuries, and major devastation in the States of Louisiana, Mississippi, and Alabama;
WHEREAS, significant relief efforts are necessary to protect the public health, to preserve public safety, and to restore the social and economic welfare of persons impacted by the storm;
WHEREAS, the Federal Emergency Management Agency requires an estimated 150,000 single and double wide homes to be transported to the area affected to provide shelter;
WHEREAS, the Federal Emergency Management Agency has requested that governors throughout the United States waive the enforcement of applicable state laws and regulations that govern the transport of oversized loads, for a period of 90 days, in order to allow the rapid movement of mobile homes;
WHEREAS, the Department of Homeland Security will provide documentation to the applicable tractor trailer drivers to enable law enforcement in Michigan to verify weather a particular oversized load is in support of the national relief effort;
NOW, THEREFORE, I, JENNIFER M. GRANHOLM, Governor of the State of Michigan, pursuant to the power and authority vested in the Governor by the Michigan Constitution of 1963 and Michigan law, direct the following:
1. Consistent with the September 2, 2005 request from the Federal Emergency Management Agency, state departments and agencies are directed to forgo enforcement of any state laws or regulations applicable to the transportation of oversized loads for the transportation of mobile homes with documentation from the Department of Homeland Security indicating that the particular oversized load is in support of the national relief effort for Hurricane Katrina.
2. This Directive shall remain in effect until December 3, 2005 unless earlier rescinded by the Governor.
This Directive is effective upon filing.
