Contract Revisions Under MCL 500.1226(4), public insurance adjusters are required to use only Commissioner approved contracts:
An adjuster for an insured shall not provide his or her services to a client until the adjuster has contracted in writing, on a form approved by the commissioner, with the insured or his or her authorized representative.
New applicants for licensure will be required to file for approval a contract that adheres to this form, with particular information filled in, such as the name of the adjuster and the address.
In addition, if currently licensed adjusters want to make changes in contracts in use, they will be required to use the new form.
Public insurance adjusters with forms in use are encouraged to file new contracts for approval right away. There are elements of the new contract form that benefit both consumers and adjusters. The Michigan Association of Public Insurance Adjusters reviewed and accepted the new contract form.
The staff will monitor use of the new form and will take action to withdraw approval of old contracts where new contracts have not been filed for approval by the time of license renewal.
