The Motor Carrier Safety Appeal Board was created by the Motor Carrier Safety Act, Public Act 181 of 1963, as amended, MCL 480.13. The purpose of the board is to hear and decide applications for waivers from medical requirements of this act and the rules promulgated under this act. The safety appeals board consists of one member from each of the following: the director of the Department of State Police or his/her designee, the Secretary of State or his/her designee, the director of the Michigan Department of Transportation or his/her designee, and one representative of the motor carrier industry chosen jointly by these three department heads and the Michigan Trucking Association.
For Drivers Who Operate Intrastate Only
A waiver issued by the State of Michigan allows the driver to engage in intrastate operations only (within the borders of the State of Michigan). The waiver is not valid for movements made in continuation of interstate commerce, for example, U.S. Mail, delivery of air freight, or as part of a movement that has an origin or destination outside of Michigan
An application for a waiver shall be submitted jointly by the person who seeks a waiver of his or her physical disqualification and by the motor carrier that will employ the person if the application is granted.
All requests for a waiver require the submission of ALL of the following:
- A completed MC-027 - Application for Waiver.
- A Medical Examination Report for Commercial Driver Fitness Determination completed by a medical examiner familiar with the requirements of 49 CFR 391.41.
- A copy of the driver's official driving record.
- A copy of the driver's employment application from the company they intend to drive for.
- A copy of crash reports for any crashes the driver has had in the last five years.
- At least one other medical report is required.
Any additional supporting documentation from medical professionals and the potential employer is welcome.
The medical condition dictates what additional information is required.
Motor Carrier Safety Appeal Board Meeting
Applicants with a history of seizures, insulin use, and cardiovascular conditions must attend a Motor Carrier Safety Appeal Board meeting before a waiver will be granted. Applicants for a vision or limb impairment may be required to attend a Motor Carrier Safety Appeal Board meeting.
The board meets the third Wednesday of January, April, July and October. All documents must be received two weeks before the board meeting.
NOTE: The Motor Carrier Safety Appeal Board's meeting dates are subject to change.
Grandfather Rights Cards
Grandfather rights cards remain valid until Dec. 31, 2014, as along as ALL of the following conditions are met:
- The driver has been a regularly-employed driver of the motor carrier for a continuous period that began on or before June 10, 1984.
- The driver continued to be a regularly-employed driver of that motor carrier.
- The driver is otherwise qualified to drive a commercial motor vehicle under this act.
- The driver has made application to the appeal board, claiming grandfathering rights.
- The driver has received a grandfather rights card from the Commercial Vehicle Enforcement Division of the Michigan State Police.
- The exemption from medical qualification under this section applies only to pre-existing conditions before Jan. 1, 1996. Any medical condition that would normally disqualify a driver under this act automatically voids any grandfather rights.
Current grandfather rights shall remain in effect until Dec. 31, 2014. All drivers of commercial motor vehicles must have a valid medical examiner's certificate or medical waiver after Dec. 31, 2014.
The department is not authorized to issue new grandfather cards under Section 4 of Public Act 181 of 1963,as amended, after the effective date of the amendment that added this section, effective Oct. 20, 2005.

School Bus Drivers
School bus drivers are only eligible for a waiver from the insulin-controlled diabetes requirement. Waivers are not available for any other medical condition. A school bus driver that was employed as a school bus driver on June 22, 2010, and had diabetes noted on his or her medical exam may be exempt from the insulin disqualification. See the Michigan Department of Education's Pupil Transportation website for more guidance on this exemption.
Additional Information for Applicants
This application must be completed accurately. This information is used in determining the areas of operation, the specifications of the vehicle and the commodities transported. If the waiver is granted, this information will be found on the medical waiver card that the driver carries and may limit the scope of operation. It is necessary to indicate the maximums for this purpose. Failure to give complete and accurate information may cause delay in obtaining a medical waiver. Application packets that are incomplete or missing required documents will be returned to the applicant. A list of common problems with the applications may be reviewed.
