THE MICHIGAN UNEMPLOYMENT INSURANCE APPEALS COMMISSION 

The Unemployment Insurance Appeals Commission (Commission) rules on appeals of decisions made by Administrative Law Judges (ALJ) on unemployment insurance matters.  It also rules on Applications for Transfers of hearings pending before ALJs.  The claimant, employer, and the Unemployment Insurance Agency are entitled to file an appeal.

The Commission is a seven-member body appointed by the Governor.  It exercises its authority independently of the Unemployment Insurance Agency. Most cases are decided by a three-member panel of the Commission.  Matters of first impression and cases of broad import are decided by the full Commission.

HOW TO FILE AN APPEAL WITH THE COMMISSION

You may E-File your appeal by completing and submitting the Appeal Form which can be accessed at the green box immediately below.

The Commission also accepts appeals by US Mail, email and by fax at the address specified in the Contact Us section below.  A printable appeal form is available in the Filing Resources section below.

There is no charge to file an appeal to the Commission.

The appeal deadline is set forth in the ALJ decision or order.

After your appeal is received at the Commission, the Commission will send you a Notice of Receipt of Appeal along with an Important Notice.  Please read these papers carefully as they provide important instructions and set forth certain deadlines.

You may apply to submit written argument, oral argument, and/or additional evidence in support of your appeal.  The deadline for submission of those requests is located at the bottom of the Important Notice. A generic Important Notice form is included in the Filing Resources section below. 

If you choose to file any of these applications electronically, follow the Email Filing Instructions located in the Filing Resources section below and send your request by email to LEO-UIAC-Info@michigan.gov.

Hearing transcripts:  Any party to a case may obtain a copy of the transcripts of the ALJ hearing by paying the cost of the transcription fee, however the transcript is not required for your appeal.  Your request should be directed to Theresa's Transcription Service.  Click on Transcription Services in the Other Resources section below for Theresa's contact information.

HOW ARE MATTERS HANDLED BY THE COMMISSION?

The Commission reviews the ALJ's factual findings and application of the law.

The Commission will mail a copy of its decision or order to all interested parties to the case.

Instructions for Rehearing and Reopening of the Commission decision are in the Notice of Rights to Appeal mailed with the Commission decision.  If you choose to file such a request electronically, follow the Email Filing Instructions located in the Filing Resources section below and send your request by email to LEO-UIAC-Info@michigan.gov.

 

APPEALS TO CIRCUIT COURT

You may appeal a final decision or order of the Commission to circuit court.  To be on time, your appeal must be received at the court within 30 days from the mail date on the Commission decision. You will find instructions on where to file your appeal on the Notice of Rights to Appeal included with the Commission decision or order.
