Michigan Civil Rights Commission to Address EQMI Request for Interpretive Statement on Sex Discrimination in Michigan Civil Rights Law

July 25, 2017

Battle Creek ? Equality Michigan (EQMI) on Monday asked the Michigan Civil Rights Commission (the Commission) to issue an interpretive statement to clarify that the prohibition against sex discrimination in the Elliott-Larsen Civil Rights Act (ELCRA) includes protection against discrimination on the basis of gender identity and sexual orientation.

In their request, EQMI pointed out that there is a lack of clarity in current law that leaves both employers and employees, landlords and tenants, and a host of others unsure of what state civil rights law covers.

In their written request, Equality Michigan said the interpretive statement “. . . is of critical importance to lesbian, gay, bisexual, transgender Michigan residents.” Nathan Triplett, EQMI Director of Public Policy presented the request to Commissioners at their meeting on Monday in Battle Creek. “This is a request to use your authority to clarify a glaring ambiguity that exits in ELCRA,” said Triplett.

In order to ensure that it is considering all points of view, the Commission has asked the Michigan Department of Civil Rights to solicit public input on the EQMI request. Beginning at 12:00 pm noon on Tuesday, July 25, 2017 through COB on Tuesday, August 15, 2017, the Department will accept public comments on the EQMI request at MCRC-Comments@michigan.gov. The Commission will address the request at their Sept. 18th meeting in Lansing, MI.
