Janine Winters, Director of the Office of the State Employer, has requested that the Commission amend Civil Service Rule 5-4.2(a) to exclude annual leave time as a basis for calculating overtime. The change would make overtime computation for NEREs consistent with recently negotiated changes applicable to exclusively-represented employees. The proposed amendment to rule 5-4.2(a), if approved, would exclude annual leave as a basis for calculating overtime, effective January 1, 2012, as follows: 5-4.2 Overtime (a) Eligibility. The compensation schedules must identify each classification that is eligible for overtime pay. Overtime pay is paid to eligible employees for time in pay status, excluding sick and annual leave, in excess of 40 hours in a week or as otherwise provided in the regulations.The Civil Service Commission will consider the proposed amendment at its next meeting, scheduled for 10:00 a.m., Thursday, December 15, 2011, at the Capitol Commons Center, 400 S. Pine Street, Lansing.
