SUBJECT: AMENDMENTS TO CIVIL SERVICE REGULATION 6.02: UNFAIR LABOR PRACTICE CHARGES
 
Proposed amendments to Regulation 6.02, Unfair Labor Practice Charges were circulated for review and comment under SPDOC 12-07, dated April 26, 2012. The changes would (1) formally state, consistent with a recent commission decision, that attorney fees and costs are not available as relief in unfair labor practice (ULP) charges; (2) formally state that hearings procedures in Regulation 8.01, which have long been informally used to conduct ULP hearings, apply; and (3) clarify the standing of employees, the employer, and labor organizations to file and participate in ULP charges. Minor changes have been made in response to comments received.

The attached regulation is now being issued with an effective date of July 8, 2012.
