Staff proposes modifying Regulation 5.02, Premium Payment of Overtime, On-Call Compensation, and Callback Compensation to better match language from the Fair Labor Standards Act and its regulations on treatment of overtime for eligible employees. Regulation 5.02 currently attempts to restate some discretionary exceptions allowed under federal law. The proposed changes would refer to federally authorized exceptions rather than attempting to restate them. Staff also proposes modifying Regulation 5.07, Performance Pay Programs to allow additional flexibility in the timing to request approval to pay performance-pay awards.
