SUBJECT: DRAFT AMENDMENTS TO CIVIL SERVICE REGULATION 8.05, EMPLOYMENT RELATIONS BOARD APPEAL PROCEDURES
 
Staff proposes changes to Regulation 8.05, Employment Relations Board Appeal Procedures. In addition to several minor stylistic changes, the proposed amendments would include the following substantive changes:
 
  • Streamlining appeals as of right. Appeals over discharges would be expedited by requiring briefs to be filed with the claim of appeal.



  •  
  • Requiring email filing and allowing proof of service by cc. Parties have complained about the proof of service requirement. All filings can be made using PDF and Word forms available at www.mi.gov/mdcs. Electronic service through established email addresses would expedite and simplify service. Parties could still request authorization for paper filing under previous requirements.



  •  
  • Not requiring signed originals and six copies. ERB filing requirements have often caused confusion and required deficiency notices. Parties have also complained that the requirements are burdensome. The ERB would assume the administrative burden of making necessary copies of electronic filings.
