Exploring opportunities to improve the Rate Case Process
Public Act 231 of 2023 directs the Commission to investigate opportunities for improving the process through which it reviews rate case applications.
On May 23, 2024, the Commission issued an order in Case No. U-21637 initiating this investigation to examine how the experiences of litigating and deciding rate cases can be improved, streamlined, or simplified. The order sought comment on a variety of process issues. In response to comments received, the Commission issued an order in Case No. U-21637 on July 10, 2025 requesting comments on the appropriate schedule for a contested settlement in a rate case; a new process for demand response reconciliations; and how potential bill impacts should be communicated to customers during rate cases; and the order also directed the Staff to file a draft proposal for exploring the potential to create proceedings to cover the Issues of costs of service and rate design separately from the determination of revenue requirement by October 30, 2025, convene a collaborative meeting with interested persons, and file a report summarizing discussions by January 15, 2026. The Commission Staff filed its proposal in Case No. U-21637 on October 30, 2025. Following the posting of the Staff report in January, the Commission will accept comments on the Staff proposal and report through February 16, 2026.
