LARA Provides Updates to Medical Marihuana Facilities License Applicants

February 7, 2018 – The Dept. of Licensing and Regulatory Affairs (LARA) released information this week to inform and advise medical marihuana license applicants regarding recent legislative updates and advisory bulletins.
2018 Public Act 10 (HB 5144) amended the Medical Marihuana Facilities Licensing Act (MMFLA) to update certain procedures. It added protections for CPAs and financial institutions working with licensees while streamlining the process for municipalities to authorize marihuana facilities. 2018 PA 10 clarifies permissible transfers between licensees and when the use of secure transporters is required.
2018 PA 10 also amends section 505 of the MMFLA to authorize a safety compliance facility to collect a random sample of marihuana at a marihuana facility of a grower, processor, or provisioning center for testing without using a secure transporter. Under Rule 32 of the Emergency Administrative Rules, a safety compliance facility must physically collect samples of marihuana product from another marihuana facility to be tested at the safety compliance facility. The sample size collected must be sufficient to complete all analysis required and reasonably assure that the test results are defensible.
The Department Approved Pesticide Chemical List Technical Bulletin released the approved pesticide chemical list – in accordance with the MMFLA and the Emergency Rules – and the standards to which the pesticide chemical residue will be compared.
