Misdemeanor Marijuana Offenses
Misdemeanor marijuana expungements can be for violations of the law related to possession, personal use, and the sale of paraphernalia. Not all misdemeanor marijuana offenses qualify under the law.
- Obtain a certified copy of your misdemeanor or local ordinance marijuana conviction.
- Fill out application to set aside the conviction.
- Attach the certified copy of your conviction to your application.
- Mail or personally deliver the application packet to the court where the conviction occurred.
- Serve a copy of the application, by mail or personal delivery, on the agency that issued/prosecuted your case.
- If the prosecuting attorney does not file opposition within 60 days, your misdemeanor marijuana expungement is complete.
- If an opposition is filed, await receipt of a notice of hearing.
- Appear before the court on the date, time, and place indicated on the notice of hearing.

Misdemeanor/Felony Adult Offenses
- Check your public criminal history with the Michigan State Police's (MSP) Internet Criminal History Access Tool (ICHAT)
- Determine if you are eligible to expunge.
- Fill out an application to set aside the conviction.
- Obtain a certified copy of your conviction(s).
- Obtain an official set of your fingerprints from your local law enforcement agency.
- Send the application packet to MSP, the convicting court, the prosecuting agency, and the Michigan Attorney General.
- Wait for a response from MSP, the prosecuting agency, and the Michigan Attorney General.
- Obtain a hearing date if you don't already have one.
- Appear at the court hearing where the judge will either grant or deny your application.
- If granted, obtain a copy of the order, and verify the court clerk is sending copies to all parties.
