NOTICE OF FINDING OF NO SIGNIFICANT IMPACT ON THE ENVIRONMENT
AND NOTICE OF INTENT TO REQUEST FOR RELEASE OF FUNDS


These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the Michigan State Housing Development Authority

Notice of Intent to Request a Release of Funds

On or about 04/08/2025 the Michigan State Housing Development Authority (MSHDA), Oakland County, and City of Pontiac will submit a request to the U.S. Department of Housing and Urban Development (HUD) for the release of HOME - ARP funds from Section 3205 of the American Rescue Plan Act of 2021 (P.L. 117-2) (“HOME-ARP”) as amended, for the release of HOME funds under Title II of the National Affordable Housing Act of 1990, and Section 8 (o)(13) of the U.S. Housing Act of 1937 (42 U.S.C. 1437f(o)(13)), and for the release of Project Based Voucher (PBV) funds under Section 8 (o)(13) of the U.S. Housing Act of 1937 (42 U.S.C. 1437f(o)(13)) as amended to undertake a project known as Auburn Place for the purpose of:

MSHDA intends to award Auburn Place Limited Divided Housing Association LLC up to (1) $11,161,306 of MSHDA HOME-ARP funds (2) $1,500,000 Oakland County HOME funds (3) 30 units of MSHDA PBV rental assistance and (4) 24 units of Pontiac Housing Commission PBV rental assistance for Auburn Place.  Auburn Place will be located at 454 Auburn Ave, Pontiac, MI 48342/Oakland County. The proposed project seeks to construct a new five-story, 54-unit apartment building. The Subject Property currently consists of a vacant 1.34-acre lot, which is to be purchased as part of the project. The proposed new apartment building is to feature 46 one-bedroom units and 8 two-bedroom units. Of the 54 apartment units, 21 units will be HOME-ARP assisted, 4 will be HOME assisted and all 54 will be assisted by PBVs. The proposed new construction will include a community room, offices, a mail room, and an elevator.

Notice of Finding Of No Significant Impact (FONSI)

The MSHDA, Oakland County and the City of Pontiac has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement (EIS) under the National Environmental Policy Act of 1969 (NEPA, 42 USC 4321) is not required. Additional project information is contained in the Environmental Review Record on file at the MSHDA office at 735 E. Michigan Ave., Lansing, MI, Oakland County Neighborhood & Housing Development Division, 1200 N Telegraph Road, Bldg., 34E, Pontiac, MI, or the City of Pontiac Mayor’s Office at 47450 Woodward Avenue, Pontiac, MI 48342  and may be examined or copied weekdays 8 A.M to 5 P.M. Public Comments

Any individual, group, or agency may submit written comments on the ERR to MSHDA’s, Oakland County’s, or City of Pontiac’s address written above. All comments received by 04/07/2025 will be considered by MSHDA, Oakland County and City of Pontiac prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.

Environmental Certification

The MSHDA, Oakland County, and City of Pontiac certify to HUD that Anthony Lentych in his capacity as Chief Housing Investment Officer,  David Coulter in his capacity as Oakland County Executive, and Tim Greimel in his capacity as Pontiac Mayor, consent to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows Auburn Place Limited Divided Housing Association LLC to use Program Funds.

Objections to Release of Funds

HUD will accept objections to its release of funds and the MSHDA, Oakland County and City of Pontiac certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of MSHDA, Oakland County or the City of Pontiac; (b) MSHDA, Oakland County, or City of Pontiac had omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) a grant recipient or other participants in the project have committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to Michelle King, PIH Representative, or Keith E. Hernandez, Director, Community Planning and Development or DetroitCPD@hud.gov, Detroit Field Office, U.S. Department of Housing and Urban Development at 477 Michigan Avenue 16th Floor, Detroit Michigan 48226.  Objections can also be submitted via email at Environmental-PublicComments@hud.gov. Potential objectors should contact HUD to verify the actual last day of the objection period.
