Final Notice and Public Explanation of a Proposed Activity in a Wetland

This is to give notice that the Michigan State Housing Development Authority (MSHDA) under 24 CFR Part 58 has conducted an evaluation as required by Executive Order 11990, in accordance with HUD regulations at 24 CFR 55.20 in Subpart C Procedures for Making Determinations on Floodplain Management and Protection of Wetlands. The proposed project is located in the western portion of 16925 Ability Way, in Grand Haven, (Ottawa County) MI (the Property). The proposed action (Gracious Grounds) includes the construction of an approximately 24,167 sq ft, three-story, 77-unit residential building offering 75 revenue-based, one-bedroom apartments to support special needs individuals/households and two non-revenue manager units. Gracious Grounds seeks to create a sustainable and affordable housing option that will increase capacity and provide housing to more individuals seeking an independent and supportive community. The proposed activity will utilize $1,775,000 in MSHDA HOME funds and will impact two forested wetlands on the Property. Wetland A (0.19a) is located along the western property boundary and Wetland B (0.19a) is located in the southeastern corner, both wetlands extend off the Property to adjoining sites. A March 29, 2024, Wetland Pre-application Meeting with Michigan Department of Environment, Great Lakes, and Energy (EGLE) Water Resources Division staff determined the Property wetlands are not subject to regulation under Part 301 and/or Part 303 of the NREPA or at the local level. 

Ecological functions and environmental benefits associated with wetland habitat include local flood control, carbon sequestering, groundwater recharge and filtration, habitat for insects, wildlife, and/or fish, and societal value (bird watching, visual appeal, photography, fishing) which have the potential to be adversely affected by the proposed activity. MSHDA and the grant recipient Gracious Grounds LDHALP considered alternative project locations; however, those sites were excluded due to not meeting one or more project requirements: located in/near Grand Haven, available for sale, size (approximately 4-acres), space for a walking path, compatible zoning/use, quiet setting for residents with sensory issues, availability of public utilities, availability of public transportation (Harbor Transit) for special needs residents, and proximity to potential employment and essential services. 

Wetland habitat impacts on the Property were determined to be unavoidable due to planning and zoning requirements including: connection to watermains through existing easements located within the wetlands, required expanded onsite parking, a fire access road north of the building, and increased stormwater retention basin capacity. Mitigation measures to be employed to minimize adverse impacts to the remaining wetland and develop future wetland habitat include: using silt fencing and other soil erosion and sedimentation control measures to protect remaining wetlands from equipment, foot traffic, and debris and revegetating the wetland areas and created stormwater pond following construction with a native wetland seed mix. 

MSHDA has reevaluated alternatives to building in the wetlands and has determined that it has no practicable alternative to wetland development, while meeting project and local regulatory requirements. Environmental files documenting compliance with Executive Order 11990, are available for public inspection, review and copying upon request at the times and location delineated in the last paragraph of this notice for receipt of comments. 

There are three primary purposes for this notice. First, people who may be affected by activities in wetland and those who have an interest in the protection of the natural environment should be given an opportunity to express their concerns and provide information about these areas. Second, an adequate public notice program can be an important public educational tool. The dissemination of information and request for public comment about wetland can facilitate and enhance Federal efforts to reduce the risks and impacts associated with the occupancy and modification of these special areas. Third, as a matter of fairness, when the Federal government determines it will participate in actions taking place in wetland, it must inform those who may be put at greater or continued risk.
