This notice shall satisfy a procedural requirement for activities to be undertaken by the Michigan State Housing Development Authority and the City of Grand Rapids.
Notice of Intent to Request a Release of Funds
On or about 08/04/2025 the Michigan State Housing Development Authority (MSHDA) and the City of Grand Rapids will submit requests to the U.S. Department of Housing and Urban Development (HUD) for the release of federal HOME Investment Partnerships-American Rescue Plan (HOME–ARP) funds from Section 3205 of the American Rescue Plan Act of 2021 (P.L. 117-2) (“HOME-ARP”) as amended. The 21 Weston Apartment building contains 96 apartments. Dwelling Place of Grand Rapids Nonprofit Housing Corporation plans to utilize a combination of 4% and 9% Low Income Housing Tax Credits (LIHTC) to finance renovations of all 96 units. Renovations shall include a new roof, new windows and doors, upgrading the elevator, replacement of the heating, ventilation, and air conditioning systems, replacement of kitchen and bathroom cabinetry, new flooring, interior painting, light fixture replacement, structural repair, and minor exterior masonry repair. MSHDA has reserved up to $5,817,768 of HOME-ARP funds and the City of Grand Rapids has reserved up to $300,000 of HOME-ARP funds for this project. The activities proposed are categorically excluded under HUD regulations at 24 CFR Part 58 from National Environmental Policy Act (NEPA) requirements. An Environmental Review Record (ERR) that documents the environmental determinations for this project is on file at MSHDA, 735 East Michigan Avenue, Lansing, Michigan 48912 and at the City of Grand Rapids Community Development Department, 300 Monroe Avenue, NW, Suite 460, Grand Rapids, Michigan 49503, and may be examined or copied weekdays 8 A.M. to 5 P.M. Public Comments
Any individual, group, or agency may submit written comments on the ERR to MSHDA’s or the City of Grand Rapids’ address written above. All comments received by 07/30/2025 will be considered by MSHDA and the City of Grand Rapids prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.
Environmental Certification
MSHDA and the City of Grand Rapids certify to HUD that Anthony Lentych (MSHDA), in his capacity as Chief Housing Investment Officer, and Mark Washington (City of Grand Rapids) in his capacity as City Manager, consent to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows MSHDA and the City of Grand Rapids to use their respective Program Funds.Objections to Release of Funds
HUD will accept objections to its release of funds and MSHDA’s and the City of Grand Rapids’ certifications for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of MSHDA or the City of Grand Rapids; (b) MSHDA or the City of Grand Rapids has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) a grant recipient or other participants in the development process have committed funds, incurred costs, or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to the U.S. Department of Housing and Urban Development, Detroit Field Office, 477 Michigan Avenue, Detroit, MI 48226, Keith E.
