Bear Lake Man Sentenced 8-40 Years’ Incarceration for Delivery Causing Death in Fentanyl Fatality

LANSING – Today, Derek Rosen, 31, of Bear Lake, was sentenced in the 19th Circuit Court in Manistee County to 8-40 years’ incarceration for Delivery Causing Death for providing fentanyl to a 30-year-old Manistee man who overdosed in April of 2020. Rosen pled guilty in September of this year. He was charged alongside Brittanty McClarty, 38, of Manistee, who pled guilty to Delivery of Fentanyl under 50 grams in March of this year. McClarty was sentenced to 1-20 years’ incarceration in April. 

Per the Michigan State Police investigation into the death of the 30-year-old victim found unresponsive in his car, McClarty provided drugs to the deceased obtained from Rosen. McClarty agreed in her plea deal to testify against Rosen, and did so at Rosen’s preliminary examination in March.   

“This sentence reflects the severity of the defendant's role in exacerbating the scourge of the opioid epidemic,” said Nessel. “Fentanyl use and overdose is a tragedy that devastates families across the state and my office will continue to hold accountable, to the fullest extent of the law, those who push this poison in our communities.”
