Attorney General Nessel Joins Opposition to Trump’s Unlawful Deployment of National Guard to Chicago, Oregon

LANSING – Michigan Attorney General Dana Nessel has joined two multistate amicus briefs supporting Illinois (PDF) and Oregon’s (PDF) challenges to the Trump Administration’s latest attempts to illegally use the military for civil law enforcement. Similar to previous illegal deployments of the National Guard, the president has relied on bombastic rhetoric and lies as pretext for taking military servicemembers from their homes to patrol cities that are not experiencing crises but that are located in states that voted against the president.
The amicus briefs argue that a central principle of the rule of law is that the military is subordinate to civilian authority. The president’s unlawful and unconstitutional use of the military has exacerbated safety issues and threatened constitutionally protected activity under the First Amendment. Moreover, the president’s actions undermine the role of local law enforcement and state sovereignty by sending federalized troops into our communities against the will of local populations.
“President Trump is trying to weaponize the military against the very people he swore to serve, a clear violation of the Constitution,” Nessel said. “Law enforcement belongs in the hands of trained civilian authorities, not soldiers torn from their families to patrol American streets. This effort to militarize our cities disrespects our National Guard, undermines state sovereignty, and threatens the rights of every citizen. I am committed to stopping this dangerous and unlawful abuse of power.”
The states also have an interest in ensuring their National Guards remain available to perform essential, ongoing services to their residents. The Guard provides critical support for public safety through natural disaster response, counter-drug operations, and cybersecurity assistance, alongside numerous other daily contributions. The unlawful federalization of the Guard pulls volunteer service members away from performing these vital services, and states are not in a position to replace this support.
State attorneys general, including Attorney General Nessel, continue preparations to defend their states from this illegal federal overreach. They are ready to act should the administration continue the illegal deployments directed to Oregon, Illinois, California, the District of Columbia, and elsewhere.
