LANSING – Michigan Attorney General Dana Nessel has reached an Assurance of Voluntary Compliance (AVC) with LPCCS, LLC, a former Florida-based company, resolving allegations that the business misled Michigan consumers through deceptive mailers. The agreement (PDF), filed earlier this month in the 30th Judicial Circuit Court in Ingham County, follows an informal investigation by the Department of Attorney General into whether LPCCS violated the Michigan Consumer Protection Act.
LPCCS allegedly sent advertising mailers to newly formed Michigan businesses requesting a payment of $108 for an “all-in-one labor law poster.” The reported mailer suggested that failure to obtain the poster could subject businesses to civil fines for not complying with workplace requirements. While the mailer contained disclaimers that the recipient is not required to purchase the poster and that LPCCS was not affiliated with any governmental entity, it is alleged the mailer was formatted to create confusion among Michigan consumers as to whether the advertisement was instead an invoice or official notice.
The company also allegedly failed to disclose that similar workplace posters are available free of charge from government entities, including the Michigan Department of Labor and Economic Opportunity (LEO). Additionally, the Attorney General’s investigation discovered that LPCCS continued sending mailers after it had been voluntarily dissolved in Florida in February 2024.
“Advertisements should be clearly identified as such, not disguised as fear tactics aimed at entrepreneurs just getting started,” Nessel said. “My office remains committed to protecting Michigan businesses from deceptive practices.”
Under the terms of the AVC, LPPCS and its managing member, Geraldo Rodriguez, are prohibited from sending mailers to Michigan residents and businesses. The company will also issue refund checks for all 121 posters sold in Michigan and pay $500 for the costs of the investigation.
The Attorney General wants new business owners to know that—because company formation records are publicly available—they can expect to receive solicitations for a variety of services and products. Unfortunately, some of these will be from entities trying to sell products and services that can be obtained from LEO or other government agencies for free or at a much lower price. As it is the newest of business owners that are most likely to be deceived, careful attention to advertisements and unexpected invoices is recommended.
