BEST VALUE CONSTRUCTION CONTRACT BIDDER EVALUATION

PA 430 of 2012 amended the DMB Act to provide that for projects funded in whole or in part with state funds, the construction contract award shall be made to the responsive and responsible best value bidder, except as provided relative to veteran's preference. 

The qualitative components of the three lowest responsive and responsible bidders will be compared to one another.   The comparison may also include other bidders whose bids are within 10% of the lowest responsive and responsible bidder.  It is expected that the evaluation may be done through face-to-face or telephone interview.  This evaluation will be done primarily by the Professional Services Contractor with assistance from the Project Director of the Design and Construction Division. 

The bidders will be evaluated for responsiveness and responsibility based criteria including compliance with all bid specifications and requirements, financial resources, technical capabilities, professional expertise, past performance, insurance and bonding capacity and business integrity.   This evaluation will be done primarily by the Professional Services Contractor with assistance from the Contracting Section of the Design and Construction Division.   

The bids will be evaluated for best value based on price and qualitative components that may include but are not limited to technical design, technical approach, quality of proposed personnel, and management plans. 

For projects bid using the MichSPEC Construction Contract and General Conditions document, the Section 0400 Qualification Submittal shall be provided by the three lowest responsive and responsible bidders, and may also be provided by bidders whose bids are within 10% of the lowest responsive and responsible bidder.   The Section 0400 Qualification Submittal review will be taken into consideration along with the Evaluation Checklist. 

For contracts under $250,000, best value will primarily be based on the lowest responsive and responsible bid.

If a Qualified Disabled Veteran (QDV) meets the requirements of the contract solicitation, provides acceptable responses to both Part One and Part Two of the checklist and, with the veteran's preference, is the lowest responsive, responsible, best value bidder, the DTMB Design and Construction Division will enter into the construction contract with the Qualified Disabled Veteran bidder.
