Claims Against the State of Michigan

The State Administrative Board (Ad Board) has authority to consider, determine, and allow claims against the State of Michigan, its departments, officers, and colleges and universities for the loss of personal property or for personal injury in amounts less than $1000.00.

Instructions on how to file claims are on this page below. This includes instructions for the general public, state employees, current or former prisoners, and individuals who had a claim denied by the Michigan Department of Transportation (MDOT).

For claims over $1000.00:

If your claim against the State is for $1,000.00 or more, you may decide to file a claim for only $999.99 with the Ad Board. You may also choose to file your claim with the Michigan Court of Claims.

What value are property losses based on?

Personal property loss reimbursements are based on present value and not replacement cost. If you can't provide a receipt or proof of the original purchase amount to assist in the figuring out the present value of the item(s), the residual balance may be calculated using the average cost.

How do I file claim against the state?

Print and complete the DTMB-1104 Claim Form.

Follow the instructions on page 2. Do not cross out anything on the form

Sign the form before a notary.

Include the following items to support your claim. Do not send us the originals, use copies. Original documents will not be returned.

  • Repair or replacement estimate(s)
  • Police Report
  • Incident Report
  • Proof of insurance deductible
  • Proof of out-of-pocket costs

My claim was denied by MDOT. Can I file my claim with the Ad Board?

Yes.

  • Contact the Ad Board Claims Analyst
    You'll need contact the Ad Board Claims Analyst to submit your claim. They'll need you to provide your name and the name of the MDOT representative who signed the MDOT denial letter.

What will I need to provide?

  • Your MDOT Transportation claim packet. 
    We'll request your claim packet from the MDOT Transportation Center and will use the same claim form and supporting documentation to file your claim with the Ad Board.

    If the MDOT-3600 Claim Form has not been notarized, we will return it to you for notarization.

How do I file a claim against the State as a state employee?

NOTE: Your department director may choose to resolve your claim if it is less than $500, except for claims than involve eyeglasses, jewelry, cash, or personal vehicle.

To file a claim as a State of Michigan employee, follow the process is the same as filing a claim against the State of Michigan:

  • Print and complete the DTMB-1104 Claim Form.
    Follow the instructions on page 2. Do not cross out any print on the DTMB-1104 Claim Form (Claim Form.) 
  • Sign the Claim Form before a notary.
    This is required.
  • Send the Claim Form and copies of any supporting documentation to us.
    You can send the Claim Form to us via email or the mail. Instructions on where to send it via mail are on page 2 of the form. A list of supporting documents we accept is below.

How do current and former Michigan Department of Corrections (MDOC) prisoners file claims?

  • Print and complete the DTMB-1104-P Claim Form or request a Claim Form from the Grievance Coordinator or designee at the correctional facility where incarcerated.
    Follow the instructions on page 2. Do not cross out any print on the DTMB-1104-P Claim Form (Claim Form.) 
  • Sign the Claim Form before a notary.
    This is required.
  • Submit the Claim Form to the Grievance Coordinator or designee at your facility per MDOC policy and procedures.
    Include copies of the documentation to support your claim.

  • Pack or Unpack documentation
  • Documentation verifying possession and ownership
