The Michigan Freedom of Information Act (FOIA) provides all persons (except persons incarcerated in correctional facilities) with access to public records of public bodies. Requests to inspect or receive public records from EGLE must be in writing and describe the requested records with enough detail to enable the department to identify and locate the requested records. Some records are exempt from disclosure under the FOIA or another statute and thus will not be provided. A fee may be charged to process your request. Please note that many records are available that do not require a formal FOIA request.

US Ecology Detroit South (USE-DS), also known as EQ Detroit, located at 1923 Frederick Street, in Detroit, Michigan (Site), is subject to multiple environmental regulatory programs, carried out by multiple government agencies. Each agency issues separate permits or licenses under the authority they are assigned under the regulations. The permit or license issued by each agency identifies what USE-DS must do to operate properly, to prevent the release of contaminants to the environment, and to limit any allowed discharge of contaminants to levels determined to be protective of human health and the environment. Each agency requires monitoring and performs independent oversight to ensure the Site is operated in a protective manner that meets the permits and license requirements. The agencies also share information to ensure compliance.
The Michigan Department of Environment, Great Lakes, and Energy (EGLE), Materials Management Division (MMD) licenses and inspects USE-DS’s hazardous waste operations, as well as non-hazardous solid waste operations. The non-hazardous solid waste operations are regulated under a separate license and regulations and are therefore not addressed in the hazardous waste license. MMD inspects USE-DS’s hazardous waste operations at least four times per year. These inspections are typically unannounced and are performed to verify the operations meet the license requirements. MMD evaluates USE-DS’s hazardous waste storage, treatment, emergency planning, employee training, and recordkeeping.
EGLE, Air Quality Division issues the permits for air emissions from the Site. Air Quality Division inspects the Site to evaluate compliance with the air quality requirements and reviews the Site’s monitoring data.
The Great Lakes Water Authority (GLWA) issues the permit for the discharge of treated wastewater into the sanitary sewer system. GLWA inspects the Site, reviews monitoring data, and conducts sampling of the Site’s discharge. EGLE, Water Resources Division oversees GLWA’s regulatory program for industrial dischargers and may also inspect the Site to audit GLWA’s program implementation.
Although the U.S. Environmental Protection Agency does not permit nor license the Site, they may also conduct inspections of the Site to verify compliance with air, water, and waste regulations.
