Legal service of process
Anyone wishing to formally serve legal documents upon the Department of Environment, Great Lakes, and Energy (EGLE), or its officers or employees, may do so by the following methods:
- Electronic service (subpoenas only)
- Certified U.S. mail, FedEx, or UPS
- Personal service
The Department of Attorney General will not accept service for EGLE, or its officers or employees, without explicit authorization to do so in a specific case.
Electronic service (subpoenas only)
In accordance with MCR 2.506(G)(3) service of a Subpoena and order to attend may be sent by electronic transmission to EGLE-Subpoena@Michigan.gov. EGLE will make a reasonable effort to return a confirmation email within two business days, however, if EGLE does not confirm receipt of service within two business days, the Subpoena must be served by another method consistent with the Michigan Court Rules. Electronic service is NOT available for serving EGLE with a Summons and Complaint at this time.

Personal service
- An EGLE employee may accept personal service of a Summons and Complaint if the document specifically names the EGLE employee as a party, regardless of whether EGLE is also named as a party.
- An EGLE employee may accept personal service of a Subpoena only if the document specifically names the EGLE employee.
- Unless otherwise specified, an EGLE employee may NOT accept personal service of a Summons and Complaint or Subpoena if it:
- names another EGLE employee;
- names another EGLE employee and EGLE as parties;
- or names only EGLE as a party.
- If the EGLE employee named in the Summons and Complaint or Subpoena is not available to accept personal service, the person attempting to serve the Subpoena or Complaint should request when the employee will be available at work and return at that time.
- If the Summons and Complaint or Subpoena names the EGLE Director, EGLE, or other member of the Executive Office, the Summons and Complaint or Subpoena must be served on EGLE’s Chief Deputy Director, his/her management assistant, or another member of EGLE’s Executive Office.
