Expedited Application Reviews for Construction Permits for Sewerage Systems to Serve the Public
In accordance with Part 41, Sewerage Systems, of the Natural Resources and Environmental Protection Act, 1994 PA 451, as amended, the construction of any new or alteration of an existing sewerage system to serve the public is required to receive a construction permit from the Department of Environment, Great Lakes, and Energy (EGLE). In accordance with Part 41 (Section 12), EGLE is providing, for a fee, an expedited application review process for construction permits. The following is a link to Section 12 of Part 41:

Project Eligibility
Eligible projects are defined in Part 41 and are limited to one of the following:
- Conventional gravity sewer extension of 10,000 feet or less that is to be connected to an existing collection system to provide sewer service to new areas previously not served by the public sewer system.
- Duplex pumping station and 2,000 linear feet or less of force main with not more than one (1) high point, that is to be connected to an existing gravity collection system to provide sewer service to new areas not previously served by the public sewer system.
- Small diameter pressure sewer system and pumping station that includes 5,000 linear feet or less of pressure sewer and not more than 25 grinder pumping stations, with each grinder pumping station serving not more than five (5) individual properties, that is to be connected to an existing gravity collection system to provide sewer service to new areas not previously served by the public sewer system.

Please note that an expedited review will not be conducted for a project that is being funded by the state water pollution control revolving fund created in Section 16a of the Shared Credit Rating Act, 1985 PA 227, MCL 141.1066a.
Expedited Part 41 Permit Application Submittal Process
1. Send a notification email of the intent to apply for an expedited Part 41 permit application review to EGLE-Expedited-Permit@Michigan.gov.
- The email must be sent at least 10 business days, but not more than 20 business days, before submission of the Part 41 permit application and associated fee.
- The project title must be in the subject line of the email and must match the project title in the subsequent permit application form.
- The email must include the applicant organization name, contact name, mailing address, email address, and phone number, along with a brief description of the project. The project must meet the eligibility requirements above.
2. Submit a completed Part 41 permit application in the MiEnviro system at least 10 business days, but not more than 20 business days, after submission of the notification email described above. Select the “Expedited” application type when completing the application form.
- The application form may be accessed in MiEnviro. Select the correct MiEnviro site before beginning a Part 41 permit application form. You may contact the Part 41 District Engineer for the county where a project is located if you need assistance with determining the correct site or linking your MiEnviro user account to a site.
- A "complete application" means an application that is completed and submitted in MiEnviro, for which all requested information has been provided and the fee payment has been received, and can be processed without additional information.
- Construction plans and specifications that require any local approvals (e.g. county, city, etc.) must include proof of the local reviews or approvals in the form of stamps on the plans or approval letters.
- For non-governmental owners, the submittal must include certification to EGLE that all required contractual service agreements and financial instruments are in place, and must include the completed, signed, and notarized Nongovernmental Ownership Checklist.
3. Payment is due at the time of application submission. The fee may be paid by credit card in MiEnviro (credit card service fees apply). Alternatively, the fee may be paid by check payable to "State of Michigan" and submitted according to the instructions below. Applicants should be aware that payments by check may extend processing times. When sending a check, a delivery method that provides tracking is suggested. An application will not be considered complete until the fee payment has been received and is processed by the Cashier's office.

The expedited review fee is based on the following fee structure:

4. If the applicant fails to sign the Part 41 permit application, submits construction plans and specifications that have not been prepared, signed and sealed by a professional engineer licensed in Michigan, or submits an insufficient fee, EGLE will notify the applicant within 5 business days of the deficiency. The application will not be processed until the deficient items are addressed. If the applicant does not provide the deficient items within 5 business days after notification by the EGLE, the application will be handled as described in item 5.
5. If application deficiencies exist, other than those described in 4 above or if deficiencies exist as described in 4 above and are not corrected within 5 business days of notification to the applicant, the department will not conduct an expedited review and shall keep the original fee amount. The applicant will be notified of the application deficiencies. Upon receipt of this notification, the applicant may correct the deficiencies and resubmit the application and request expedited review based on the following:

6. EGLE shall review and make a decision on complete applications submitted with a request for expedited review within 10 business days of receipt by the department of a complete application. However, if the department waives the notification requirement of subsection (4)(a) of Section 12 of Part 41, the department shall review and make a decision on the application within 20 business days of receipt of a complete application.
EGLE will notify applicants electronically of decisions regarding expedited review requests. If a permit is issued, the permittee will be notified via the MiEnviro system, and the issued permit will be available in MiEnviro.
