Non-Criminal Justice Agencies
Noncriminal Justice Agencies:
An NCJA is a governmental agency authorized by federal statute, executive order, or state statute and approved by the U.S. Attorney General to receive state and federal fingerprint based criminal history record information (CHRI), directly or indirectly from the MSP. Such agencies include state governmental departments, public colleges and universities, county/city governmental departments required or wishing to fingerprint background check employees or volunteers having unescorted access to vulnerable populations, along with Michigan K-12 Public, Non-Public, and Charter Schools required to fingerprint background check employees (or wishing to fingerprint volunteers) having unescorted access to vulnerable populations.
Purposes to receive CHRI include but are not limited to, employment suitability, licensing determinations, immigration and naturalization matters, and national security clearances.
Beginning in 2010, the MSP established a compliance program for agencies requesting CHRI for noncriminal justice purposes. Every agency with noncriminal justice access to state and/or federal criminal history records is required to follow the FBI Criminal Justice Information Services (CJIS) Security Policy.
We offer training and serve as a resource for these agencies to help ensure compliance with federal and state regulations regarding criminal history records. We also conduct periodic compliance reviews for NCJAs based on the authority of Title 28 CFR 907.3; Title 5 USC 552 a(e)(10); CJIS Security Policy and Security and Management Control Outsourcing Standard.

- Denial to Share
A template for a NCJA to be used in an instance when the agency is not going to share a CHRI response with another qualified entity.
- NCJA Information Security Policy
A template for a NCJA use in order to meet the federal requirement. A NCJA in receipt of CHRI is required to establish policy and procedures to ensure the appropriate security and management controls necessary.
- Secondary Dissemination Log
A template for a NCJA to use in any instance where a Criminal History Record Information (CHRI) response is shared with another qualified entity outside the original request.
- Voluntary Background Check
A template for a NCJA to use as representation of supporting documentation “Position Description” for audit purpose when requesting fingerprints (approved by state or federal statute) or conducting an Internet Criminal History Access Tool (ICHAT) name search, on volunteers of the agency. Position description is the proof/purpose of the fingerprint request.
- Determination for Assignment
A template for a NCJA use, commonly referred to as a red light/green light notification and is to be used when the agency is utilizing a contractor for individual assigned to regularly and continuously work under contract in a K-12 school education position.
- Agency Appeal Process
A template to be used in instances when an applicant is wishing to challenge, correct, or update any questionable information provided in his or her CHRI response received as the result of a state and federal fingerprint based background check.

CJIS Online - TAC - LASO
Security Awareness Training (SAT) is now maintained within CJIS Online. This program simplifies the maintenance of users and training records for agency administrators, retaining everything in one place. Notifications are sent at regular intervals when training is set to expire, advising the administrator and the user both to ensure training is completed before expiration.
As of January 1, 2025, all SAT conducted within Mi-Train is expired.
At this time, the requirement for Local Agency Security Officer (LASO) training is met with the highest level of SAT, the security role. Your agency administrator can set your access level, which will meet the certification requirement for LASO.

Reporting CJIS Violations
Misuse of CJIS data is required to be reported to the CJIS Compliance Unit.
There is no official form for reporting CJIS misuse. Please contact MSP-LEINComplaints@michigan.gov to begin the reporting process.
Violations of MCL 28.214 require review by a prosecuting attorney for a decision about charges. Personal use and unlawful dissemination, whether intentional or unintentional, will need a written decision submitted to the CJIS Compliance Unit. Further, any misuse of Michigan Secretary of State (SOS) information will be reported for additional investigation and possible sanctions by SOS.
Digital and physical incidents that significantly endanger the security or integrity of CJIS data must be reported to the MSP Information Security Officer immediately at MSP-CJIS-ISO@michigan.gov on this form.
