The Michigan Freedom of Information Act (FOIA) provides all persons (except persons incarcerated in correctional facilities) with access to public records of public bodies. Requests to inspect or receive public records from EGLE must be in writing and describe the requested records with enough detail to enable the department to identify and locate the requested records. Some records are exempt from disclosure under the FOIA or another statute and thus will not be provided. A fee may be charged to process your request. Please note that many records are available that do not require a formal FOIA request.

The Dow Chemical Company (Dow), Michigan Operations, Midland Plant is a chemical manufacturing complex located at 1790 Building, Washington Street in Midland, Michigan, and the Dow, Michigan Operations, Salzburg Road Landfill is a hazardous waste landfill located at 2314 West Salzburg Road, in Midland, Michigan. The combined Midland Plant and Salzburg Road Landfill complex is comprised of approximately 2,052 acres. Dow manufactures a variety of chemical products using a variety of process equipment including reactors, distillation/fractionation columns, separators, storage tanks/silos, boilers, condensers, thermal heat recovery, oxidation units, scrubbers, etc. at various locations within the Dow Chemical complex. Many locations across the complex generate hazardous waste which Dow is licensed to store, treat, and dispose of under the hazardous waste license for the Site issued by the Michigan Department of Environment, Great Lakes, and Energy (EGLE), Materials Management Division (MMD). Dow's license also cover the Salzburg Landfill located southwest of the intersection of Waldo and Salzburg Roads.
Environmental clean-up activities performed to address contamination resulting from licensed hazardous waste treatment, storage and disposal facilities is referred to as "corrective action" in the hazardous waste regulations. Licensed hazardous waste treatment, storage and disposal facilities are required to submit corrective action documents detailing how the facility will investigate and clean-up any contamination resulting from the licensed activities. These documents must be submitted according to a schedule found in Part XI of the license. The license also specifies the environmental monitoring that is required to be performed in Part IX of the license.
Air emissions from Dow's incinerators and manufacturing operations in the past contained dioxins and furans which were found in the soil downwind of the plant. Today, Dow has a rotary kiln incinerator that is 99.999 percent efficient in eliminating dioxin and furan emissions. However, due to past operations, Dow continues to work with EGLE, EPA and the US Fish and Wildlife service to address dioxin contamination in the Midland and downstream floodplain area.

EPA/EGLE/Dow Administrative Settlement Agreement and Order on Consent for the Tittabawassee and Saginaw Rivers and Floodplains and Saginaw Bay federal Superfund Site. Purpose and Scope of Work.
To frame the purpose and scope of work for performing cleanup at the federal AOC Superfund Site, EPA, EGLE, and Dow Chemical entered into an agreement that clarifies Dow's corrective action obligations to address the Midland and downstream floodplain areas contamination resulting from historic operations. In addition, Dow is responsible to take actions under a Natural Resource Damage Assessment under the supervision of the U.S. Fish and Wildlife Service.
