New State Department for Radiation Safety; CT Rules Progress (Posted 3/10/2011)
Governor Snyder issued Executive Order 2011-4 which reorganizes the Department of Energy, Labor, and Economic Growth. The department's new name will be the Department of Licensing and Regulatory Affairs, reflecting its leadership role in the state's regulatory process and its increased licensing responsibilities. The order also moves the Bureau of Health Systems, which includes the Radiation Safety Section, from the Department of Community Health to this new department. The executive reorganization order was signed February 23, 2011 and becomes effective April 24, 2011.
The Governor also issued Executive Order 2011-5 creating the Office of Regulatory Reinvention within the Department of Licensing and Regulatory Affairs. The office will review current rules and regulations as well as proposed rulemaking and regulatory activities by departments and agencies. We have been informed that the creation of this new office, which will replace the State Office of Administrative Hearings and Rules (SOAHR), has put a hold on all current rule activity including the CT rules.
The current status of the CT rules is that the Legislative Service Bureau (LSB) has certified the rules for form, classification and arrangement and returned them to SOAHR where they are on hold. The next step would have been to send the rules to the Joint Committee on Administrative Rules (JCAR). If JCAR does not object to the rules, they are filed with the Office of the Great Seal and immediately become effective.
