Governor Gretchen Whitmer recently signed the ‘Restoring Workers’ Rights’ bill package restoring and protecting workers’ rights in Michigan.
Restoration of Collective Bargaining Rights
On March 24, 2023, Governor Whitmer signed Senate Bill 34, with the goal of restoring collective bargaining rights in the private sector by allowing union security agreements between employers and labor organizations.
The law was passed without immediate effect. It will become effective on the 91st day following adjournment of the 2023 legislative session, which would be March 31, 2024, or sooner depending on the date of adjournment.
The Governor also signed House Bill 4004, amending the Public Employment Relations Act, with the goal of allowing union security agreements in the public sector. Generally speaking, this law will also become effective on the 91st day following adjournment of the 2023 legislative session, which would be March 31, 2024, or sooner depending on the date of adjournment. There are, however, portions of the law that will not become effective unless the United States Supreme Court reverses or limits its Janus decision or the United States Constitution is amended.
