Michigan adopted federal rules specific to healthcare facilities generating hazardous waste pharmaceuticals (HWP) on April 28, 2025.  The new rules became effective on May 5, 2025.  The new management standards for HWP from healthcare are found in Part 8 of the Part 111 hazardous waste rules, specifically Rules 824 through 833.  The new rules adopt the United States Environmental Protection Agency (U.S. EPA) hazardous waste pharmaceuticals rule found under Subpart P of the Resource Conservation Recovery Act (RCRA) rules.   As required under federal regulations, Michigan’s universal waste designation for pharmaceuticals was rescinded to meet the federal rulemaking mandate. The federal rules were promulgated on February 22, 2019, became effective August 22, 2019, and include a ban on sewering hazardous waste pharmaceuticals for disposal.

As required under federal regulation, Michigan adopted the federal regulations into Michigan’s rules which became effective on May 5, 2025. The universal waste designation for pharmaceuticals was rescinded to meet the federal rulemaking mandate. Consequently, as of the effective date of the new rules, hazardous waste pharmaceuticals can no longer be managed as universal waste in Michigan.
