Submittals Under Legal Agreements

Draft or final submissions required under legacy (“legacy” meaning prior to October 1, 2025) legal agreements must either be submitted in a manner that complies with the requirements of the legal agreement OR submitted via RIDE using the instructions below. Legal agreements include consent orders, judicial decrees, administrative orders by consent, land use agreements and post-closure agreements.
 
Draft or final submissions required under a non-legacy legal agreement must be submitted via RIDE. Failure to do so may result in the submission not being accepted by the department. Draft Submittals under Legal Agreements

Use the Non-Form submittal type when submitting a draft report under a legal agreement. The Non-Form submittal category will be “Submittals under Legal Agreements,” and the title should begin with “Draft.”  The first page of the draft report should identify the type of report and specify that the report is a draft. Final Submittals under Legal Agreements

Once a draft submission has been approved, the final submission should be provided through RIDE using the appropriate submittal type (e.g. FAR, NFA, etc.), or as a Non-Form if the submittal type is unavailable in RIDE. Available submission types in RIDE are listed on the RIDE Submittal Types & Guidance webpage. Notification for approvals and denials will be done in accordance with the specific legal agreement. 

 

Financial Assurance Mechanisms (FAM) Submittals

All original Financial Assurance Mechanisms (e.g. letter of credit, Certificate of Deposits, etc.) should be submitted to the RRD, Compliance & Enforcement Section Manager at the central mailing address.  O&M cost estimates for five-year FAM reviews related to legacy agreements can be submitted through RIDE as a non-form or according to the agreement; non-legacy agreements should submit O&M cost estimates for five-year FAM reviews through RIDE as a non-form.
 

Withdrawing a Submittal 

To withdraw a draft or final submission, please email EGLE-RIDE-Admin@michigan.gov and we will process your request.
