391.41(b)(8) Epilepsy and/or Seizures
An established medical history of this condition is more than one unprovoked episode without regard to time lapse between episodes. Drivers with this condition may be approved for a medical waiver provided at least one year has passed since the last episode and the treating physician's examination completed at least one year from the last episode indicates the driver is stable with a favorable outlook. The treating physician's professional medical opinion must state the driver is otherwise qualified and can safely operate a commercial vehicle. Any non-Schedule I medication may be allowed provided the treating physician discloses details about the medication to include start date, dosage, and whether the driver is following instructions pertaining to the use of medication. This may be indicated on the form MC-028 or the physician may provide a statement in addition to the MC-028.
