Line 5: public comment opportunities

About the proposed reissuance of Enbridge Energy's NPDES permit

Enbridge Energy prepared a draft National Pollutant Discharge Elimination System (NPDES) permit seeking authorization to discharge treated wastewater associated with the construction and operation of the proposed Line 5 tunnel project under the Straits of Mackinac. Enbridge Energy facilities are proposed to be located at 16309 Headlands Road, Mackinaw City (south side facility) and North Straits, Boulevard Drive (north side facility). 

This draft NPDES permit (application #HQ5-4ZB5-TRVDJ (NPDES Permit No. MI0060278)) was prepared in compliance with the provisions of the federal Clean Water Act (Federal Water Pollution Control Act, 33 U.S.C., Section 1251 et seq., as amended); Part 31, Water Resources Protection, of the Natural Resources and Environmental Protection Act, 1994 PA 451, as amended (NREPA). 

Due to the substantial public interest in the proposed permit reissuance, the public notice period will run from May 19, 2026, through June 30, 2026.

Public meeting and hearing

A virtual public meeting and public hearing was held on June 18, 2026, at 6:00 p.m. EST to seek public input on the proposed project.

The public meeting started with a brief presentation followed by a question-and-answer session. After the public meeting, the public had an opportunity to provide comments on the proposed permit during the public hearing, where comments were received for the record. Additional comments will be accepted online through June 30, 2026.

EGLE has established a dedicated permit application mailbox related to the proposed tunnel project, EGLE-Enbridge-Public-Comments@Michigan.gov to provide the public with a simplified means of commenting on the proposed project.
