Petition for Permit Application Review

If a permit applicant has a dispute with EGLE while their permit application is pending, the applicant may complete an Environmental Permit Review Petition for Permit Application Review. If the dispute cannot be resolved informally, the Chief Deputy Director (or designee) will convene a Permit Application Review meeting with the applicant and the EGLE Division to hear the issues in dispute, the relevant facts, and any data, analysis, opinion, and supporting documentation. After the meeting, the Chief Deputy Director (or designee) will issue a recommendation to the Director and the applicant. The Director will then issue a written decision that either agrees or disagrees with the  recommendation.

How the process works:

  • You will receive a confirmation of receipt of the petition from the EGLE-Permit Appeal Support Staff.
  • A meeting will be scheduled within 45 days of the petition submittal. Parties have the option of attending the meeting virtually or in-person in Lansing, MI.
  • One week before the meeting, the petitioner may submit an additional position document, including supplementary information such as diagrams or maps. The EGLE division reviewing the permit application will submit a position document. All position documents will be shared with the other party.
  • At the scheduled meeting, each party will be allowed a set amount of time to present their position. The Chief Deputy Director, or designee, may ask each party questions to further understand the issues before recommending a decision.
  • Within 45 days following the meeting, a formal written recommendation will be issued to the EGLE Director with a copy sent to all parties.
  • Within 60 days of the EGLE Director receiving the recommendation, a decision will be issued on the matter and sent to all parties.
