Effective on March 17th, 2011, an updated Operator Selection System was put into place. The Elected Operators Committee (EOC) presented several motions to the Commission Board that were adopted and implemented immediately. The following EOC motions were passed by the Commission Board regarding the Operator Selection System:
Motion 1: All operators’ accumulated points will be frozen as of the date that the new selection point system is implemented and will then be added to as earned under the new selection point system;
Motion 2: From the date the new selection point system is implemented or from date of first agreement): Licensed operators accumulate 3 points per year of service. Temporary operators accumulate ½ point per year of service. Potential operators (including those who are working for an Operator) accumulate 0 points;
Motion 3: Profit Expectation (based on the previous 12-month average): An operator is given 1 point for exceeding their facility’s profit expectation. If an operator, who has been granted a profit percentage exception, exceeds the facility’s permanently assigned profit percentage expectation, the operator is awarded one point for exceeding the permanently assigned profit percentage expectation;
Motion 4: Training (from implementation of new selection point system): Bidders are awarded 2 points for attending mandatory training (e.g. annual Workshop) and have the opportunity to earn 1 point for any training that has been pre-approved by the Training Subcommittee with a limit of 3 points per year. Training does not include the initial, basic vending stand training;
Motion 5: EOC membership, active subcommittee participation and OJE trainer (from implementation of new selection point system): Bidders are awarded 2 points per year for EOC membership or active subcommittee participation, limited 2 points per year. An active subcommittee member needs to attend a minimum of 2 subcommittee meetings per year and two EOC meetings per year. An operator must complete one year on a subcommittee or in the EOC before points can be awarded;
Motion 6: OJE training (from implementation of new selection point system): Bidders are awarded 1 point for each OJE student trained with a maximum of 4 points per year;
Motion 7: Evaluation: maximum of 2 points awarded. The most current operator annual evaluation is scored by an operator’s promotional agent on a scale of 0(low) to 2(high). This component uses the raw annual evaluation score (i.e. 0, 1, 2);
Motion 8: The Set-aside fee: Points are deducted for each month the set-aside fee was received after the due date. For the purposes of bid evaluation, set-aside fee payments for the most recent 12 months are reviewed and 1 point is deducted for each late set-aside fee payment;
Motion 9: Those points no longer are removed from an operator who fails to meet their required profit expectation;
Based on the EOC motions adopted, the Commission took the following steps regarding each motion:
Regarding Motion 1, the Commission recorded all points detailed on the BEP Database under the old Operator Selection System on 17 March, 2011, and will be using that as a baseline that all additional points for an operator may be accumulated. Operators will be given until 31 May, 2011, to review these point totals and remedy any discrepancies. After 31 May, 2011, the point total that has been recorded for each operator will serve as the baseline for the remainder of the operator’s BEP career;
Regarding Motion 2, the Commission will begin to record 3 points per year of service for those operators who had signed a Vending Facility Agreement prior to 17 March, 2011, as of the effective date of the motion. Thos operators who did not have an active Vending Facility Agreement prior to 17 March, 2011, will begin to accumulate 3 points per year of service as of the date that they entered into an active agreement. These points are cumulative;
Regarding Motion 3, the Commission will review an operator’s Vending Facility Monthly Reports for the past twelve (12) months in order to determine if they have successfully exceeded their required profit percentage. If an operator’s average profit percentage for the past twelve (12) months does exceed the required profit percentage for their current facility, one point will be recorded in the operator record. These points are not cumulative;
Regarding Motion 4, the Commission will record 2 points for attendance at the Operator Annual Workshop, currently the only mandatory training. Additionally, the Commission will record those points awarded by the EOC Sub-committees for training that has been completed that has been preapproved by the EOC. It is the understanding of the Commission that there are currently no preapproved trainings and that a list will be developed by the EOC to be distributed to all operators shortly. These points are cumulative;
Regarding Motion 5, the Commission will record points for those EOC members who complete one year of service as outlined in the specific language of the motion. The Commission cannot record points for EOC membership until an approved attendance list has been provided by the EOC. These points are cumulative;
Regarding Motion 6, the Commission will begin to record points for OJE Trainers at one point per student, not to exceed 4 points per calendar year, beginning with those operators who train students in the June 2011 Training Class. These points are cumulative;
Regarding Motion 7, the Commission will continue to record points based on the results of the Operator Annual Evaluation. The raw score of the evaluation will be used in order to determine how many points to be recorded on an annual basis. These points are not cumulative;
Regarding Motion 8, the Commission will, for the purposes of bid evaluation, review the previous twelve (12) months of Set Aside Fee payments. One point will be removed from the operator’s total for each late payment in the past 12 months. The points are cumulative only for the past twelve months;
Regarding Motion 9, the Commission will no longer remove points from those operators who are not meeting their established profit expectation. As outlined in the BEP Promulgated Rules, those operators who fail to meet their required profit expectation or the established expectation as a result of a profit percentage review are not in compliance and are not eligible to be awarded a facility.
