WIP Background and Purpose

The Wetland Identification Program (WIP), was established by the State of Michigan in 1998 to assist the public in identifying wetland and non-wetland (i.e., upland) areas on their property.  This program provides applicants with a three-year jurisdictional guarantee of wetlands and wetland boundaries within a specific area of land referred to as the “WIP assessment area”.  All WIP service applications are accepted by EGLE year-round, but those received from October 1 through winter are held until the onset of the spring growing season, which is typically mid-April in southern Michigan.  The WIP assessment service application is not an application for an EGLE wetland permit (e.g., a state-issued permit to impact a wetland).

The WIP assessment service application has a fee that scales in relation to the size of an assessment area.  The WIP application is completed on-line through EGLE’s MiEnviro portal.  WIP fee payments are typically transferred electronically via MiEnviro or as described in MiEnviro Application Payment Options.  The status of WIP assessment service applications can be monitored via MiEnviro.  A WIP service application requires supporting documentation such as a defined assessment area location map and property owner permission. 

Before deciding to apply for a WIP assessment, it is common to first participate in an EGLE district Pre-Application Meeting on site with EGLE district staff (i.e., staff based within your region of the state) to discuss any proposed project that may impact wetlands; during a Pre-App Meeting, EGLE district staff can determine if a wetland delineation is necessary and whether a WIP assessment is recommended by EGLE. 

The “Level 1” WIP service has been discontinued because it has been effectively replaced by EGLE’s online Wetlands Map Viewer.  The two remaining levels of WIP service and associated fees are as follows:

 

Level 2 WIP Service: 

This WIP service was developed primarily for relatively small, non-commercial projects such as determining the location of a non-wetland site for a driveway, a single house, or an outbuilding.  Level 2 WIP service consists of an on-site review by EGLE staff within a specific area of land (i.e., WIP Review Area) up to five acres in size.  Staff from EGLE will identify wetland boundaries on site with survey flagging, will GPS all wetland boundaries, and will determine whether the wetland(s) is regulated by EGLE under Part 303.  Upon completion of a Level 2 WIP on-site review, a report/map is sent to the applicant identifying the boundaries of any regulated wetlands and/or unregulated wetlands within the WIP Review Area.  The report/map will provide a guarantee of the areas of wetland onsite regulated by EGLE for three years from the date of the site inspection.  Please note that any land not specifically included in the official WIP Review Area will not be included within the final EGLE WIP report/map.

Level 2 WIP Service Applications MUST include several essential documents to be considered as complete.  An incomplete WIP application will prevent EGLE from completing a WIP service request.

Level 3 WIP Service

This WIP service offers an on-site review of any specific area of land (i.e., WIP Review Area, unlimited acreage) by EGLE staff to verify a wetland delineation (i.e., identification of flagged wetland boundaries) previously completed by a wetland professional (i.e., consultant).  Wetlands within the WIP Review Area must be delineated, flagged, and GPS-mapped prior to submittal of a Level 3 WIP service application.  Often a project area is much smaller than the actual property parcel(s), so a smaller WIP Review Area is mapped by the consultant instead of the entire property.  EGLE staff will determine whether a wetland is regulated by EGLE under Part 303.  Upon completion of a Level 3 review, EGLE produces a report and site map(s).  The WIP report/map(s) will provide a guarantee of the areas of wetland onsite regulated by EGLE for three years from the date of the site inspection.  Please note that any areas not specifically included in the official WIP Review Area will not be included within the final WIP report/map(s).

What is the difference between a WIP service application and a wetland construction permit application?

A Pre-Application (Pre-App) meeting is another option that may be quicker, more useful for some site planning purposes.  An on-site Pre-App meeting with EGLE staff will typically result in verification of whether or not a permit is required for a project, but precise wetland boundaries will not be determined by EGLE.  A WIP service will result in defined wetland/upland boundaries, verified by EGLE.

Additional information pertaining to the Wetland Identification Program

  • Occasionally, extensive mowing of vegetation has occurred which temporarily prevents completion of an accurate wetland assessment.  In this situation, EGLE will typically notify the applicant that it will be necessary to leave the site undisturbed for a while during the growing season.  Occasionally, EGLE WIP staff arrive on site and find what appears to be recent, severe destruction of a wetland (e.g., filling, grading, draining).  In this situation, the WIP assessment will typically be placed on hold until the apparent wetland violation has been rectified. 
  • This is uncommon.  Occasionally EGLE WIP staff may need to visit a WIP site more than once.  This may be because a recent disturbance (e.g., widespread mowing) prevented an accurate WIP assessment during the first visit.  EGLE WIP staff may need to re-visit a Level 3 assessment site if a consultant’s initial wetland delineation mapping is severely deficient.  Additional site visits by WIP staff may result in an additional fee of one-half of the original fee.
  • Although this situation is uncommon, applicants may request expedited handling of their Level 2 or Level 3 WIP service request for an increased fee of triple the standard fee.  A WIP service request can only be handled by EGLE as Express between May 1 and October 1.  Express WIP service requests are intended only for unique, uncommon situations.  The vast majority of WIP service requests are completed as regular (i.e., non-Express) assessments.  For a tripled fee amount reflecting the additional cost to the agency, EGLE will attempt to provide an Express WIP report/map within twenty calendar days of receiving a complete WIP application.  The twenty-day calendar “clock” is halted during any period when a consultant is unavailable to meet EGLE on site.  It is also halted while EGLE waits (i.e., after the EGLE site visit) for the consultant to provide updated, complete wetland delineation information (e.g., GIS mapping data).
