Baseline Environmental Assessment (BEA) submittal instructions

Submittal description

A Baseline Environmental Assessment (BEA), as defined by Part 201, Environmental Remediation and Part 213, Leaking Underground Storage Tanks, of the Natural Resources and Environmental Protection Act, 1994 PA 451, as amended, for the purpose of establishing an exemption to liability pursuant to Section 20126(1)(c) and Section 21323a(1)(b) for a new owner or operator of property that is a facility as defined by Section 20101(1)(s) or Property as defined by Section 21303(d).

RIDE submittal

EGLE requires that this submittal type be provided using the Remediation Information Data Exchange (RIDE) system. Specific information on uploading submittals using RIDE is on the Electronic Submittals guidance page. If you are already a RIDE User, navigate to MiLogin for Business to access RIDE.

Secondary certification

This submittal requires both primary certification (usually a consultant) and secondary certification (the regulated entity). Certifications act as the electronic signatures for submittals using RIDE.  For more information, please visit the secondary certification guidance page.

Administrative requirements

The following elements must be provided for the submittal to be accepted by EGLE:

  • Secondary Certification by the Regulated Entity is required. If the consultant is performing Secondary Certification on behalf of the Regulated Entity, then EQP4032 must be completed and placed as the first pages of the Attachment.
  • Phase I ESA: Do NOT include the environmental database search report (e.g., EDR Radius Map Report) or copies of EGLE files.
  • Phase I ESA: DO include all historical aerial photographs, Sanborn FIRE Insurance maps, etc.
  • Do NOT submit copies of documents that already exist in EGLE district office files.
  • DO provide copies of pertinent information and a reference to the location of the complete information within the EGLE file. Example: include data tables and maps in the BEA but only reference the supporting analytical reports located in EGLE files by providing the file name, facility or site number, report name, and report date.
  • Remove any attachments and all personally identifiable information from the BEA prior to submittal to EGLE.

 

If you are unable to find an existing location in the Inventory of Facilities, please refer to our Location Not Found feature. This feature will primarily be used for the submittal of BEAs but could be used for other Part 201 submittals as well.

 

Secondary Certification for a Location Not Found Submittal

When using the Location Not Found feature to submit via RIDE, you will receive an email with the Facility ID for your submittal(s). Once you receive the email, you can navigate to your submittal(s) using the newly created Facility ID number and perform the secondary certification step. The report will not be considered administratively complete until secondary certification is completed

A RIDE entry should be created for each organization/contact that is submitting the BEA report. For example, if a BEA is being submitted on behalf of an owner and two separate operators, there needs to be three RIDE entries for the submittal. The attachment, however, only needs to be included with one of the three entries. This is also true when using the Location Not Found feature.

 

Secondary Certification for submittals with multiple regulated entities

If using the Secondary Certification Authorization Form (EQP4032) for the secondary certification step, each regulated entity needs to fill out form EQP4032 and it should be included as the first pages of the attachment of the report. If you are not using the Secondary Certification Authorization form, each regulated entity would need a RIDE user account, then they can access their submittal and perform the secondary certification step.

A request for inconsequential determination of a BEA can be submitted after a BEA submittal. If submitted through RIDE, please use the non-form category.
