Notice of Public Hearing: Special Education Programs and Services Rule Set 2026-14 ED
The Michigan Department of Education (MDE) Office of Special Education (OSE) will hold virtual and in-person public hearings to receive public comments on proposed changes to the Special Education Programs and Services rule set.
R 340.1701a, R 340.1721, R 340.1721b, R 340.1721e, R 340.1781, R 340.1782, R 340.1851, R 340.1852, and R 340.1853 are proposed to be amended, and R 340.1784 is proposed to be added. The purposes of the proposed amendments are to align the rules with MCL 8.6 regarding timelines; align the definition of “agency” with 34 CFR 300.33 by removing private entities from the definition; address a district’s notice responsibility under 34 CFR 300.503 when it will not conduct a requested evaluation and after any individualized education program (IEP) team meeting; remove the language allowing delay of a state complaint due to informal resolution, aligning the rules with 34 CFR 300.152(2); delete the provision about allowing “stay put” of a student placement in a state complaint, aligning the rules with 34 CFR 300.518; and add a new stand-alone special education teacher endorsement to allow an educator to be placed in programs for students across multiple disability identification areas. Other proposed amendments improve grammar and align the rules with Administrative Rules in Michigan: A Manual of Style (2023).

Written comments about the proposed rules must be received by the MDE no later than 5:00 p.m. on October 16, 2026. The MDE OSE will review and consider all timely written comments. Written comments may be submitted in the following ways:
