Michigan State Superintendent, State Board President Support Lawsuit Over Federal Withholding of Funds That Harms Children

LANSING – The Michigan Department of Education is issuing the following statement from State Superintendent Dr. Michael F. Rice and State Board of Education President Dr. Pamela Pugh on a lawsuit filed today by Michigan Attorney General Dana Nessel and other attorneys general in response to the U.S. Department of Education June 30 notification that states would not be receiving appropriated federal Title funding that supports students and schools:

“I appreciate the opportunity to join once again Attorney General Nessel’s efforts to fight this illegal withholding and other unlawful federal actions over the last six months that hurt children in Michigan and nationwide,” Dr. Rice said. “The withholding of federal Title funding negatively and disproportionately affects students who are economically disadvantaged, are migrants or English learners, or need extra help with academics before-school, after-school, or during the summer. Our schools and school districts rightfully believed that funds appropriated by Congress and signed into law by President Trump would be forthcoming. Now schools are left to scramble to try to figure out how to provide programs that are vitally important to children. This is an outrage that needs to be stopped in court.”

Dr. Pugh agreed.

“The Trump administration’s decision to withhold these critical funds is not just reckless. It is cruel,” Dr. Pugh said. “It punishes the very children and educators who need the most support, and it undermines the stability of our communities. I am grateful to Attorney General Dana Nessel for standing up to this outrageous attack on our schools and fighting for what is right.”

Concurrent with the case filing, the states filed a motion for a preliminary injunction supported by a written declaration from Dr. Rice that describes how the withholding of Title funds affects children, local school districts, and the Michigan Department of Education.
