Section 8538 of the Elementary and Secondary Education Act (ESEA) requires affected local education agencies (LEAs) to consult with Indian tribes and Tribal organizations on issues impacting Native students. An affected LEA is defined as an LEA with:

• An enrollment of 50 percent or greater American Indian or Alaska Native students OR
• A Title VI Indian Education grant of more than $40,000
