Unfair Labor Practice Not Found. Summary Dismissal Warranted Where Charge Failed to State a Claim upon which Relief can be Granted; Charge Did Not Provide Sufficient Factually Based Allegations to Support a Claim of a Violation by the Union of Its Duty of Fair Representation. Claim of Improper Ex-Parte Communication Rejected Where the Information Obtained is Neither Privileged nor Confidential and is Readily Available to Interested Parties and the Public at Large. Respondent’s Alternate Basis for Charge Dismissal Rejected as Beyond MERC’s  Jurisdiction; PERA Does Not Require a Charging Party to Exhaust Internal Remedies Prior to Filing a Charge.

Research Assistants are Not Employees under PERA.  Commission’s Jurisdiction does not Extend to non-Employees. 1981 Commission Decision Determined the Same Group of Research Assistants were Not Employees; In the Absence of Showing of a Substantial and Material Change of Circumstance, Commission is bound by its precedent.  Parties’ agreement to recognize Research Assistants As Employees Not Binding on Commission; Public Employee Status cannot be Created through an Agreement Between the Parties.
