How to Appeal an MRS Decision

If you disagree with a decision made about your Michigan Rehabilitation Services (MRS) case, you have the right to appeal. Here are the steps:

  1. Request a formal hearing (and optional mediation).
    If you disagree with an MRS decision, you can ask for a hearing. You must request a hearing within 30 days of the date the decision was made. To request a hearing, send a letter to the MRS Bureau Director explaining:
       - The decision you disagree with
       - The MRS office serving you
       - Whether you want a formal hearing

  2. What happens at the hearing?
    Hearings are held within 60 days of receiving your request unless both sides agree to more time. The hearing officer is not an MRS employee. You may bring witnesses, present information, and question MRS’s evidence. You will receive a written decision within 30 days after the hearing. If you disagree with the decision, you may take the case to circuit court.

  3. Your rights during the appeal process.
    You may be represented by a parent, guardian, family member, CAP advocate, or attorney. You may request that any service already authorized continue during the appeal. MRS can provide accommodations (like interpreters, large print, or transportation). You may request and review copies of relevant MRS policies and your case record.

Other resources you can use to help you resolve a disagreement with MRS include: 

  • Consider mediation.
    You may ask for mediation when you request a hearing. Mediation is voluntary, uses a neutral mediator, and is scheduled at a convenient location. If you do not reach an agreement, you still keep your right to a hearing.

  • Talk with your counselor.
    Many problems can be solved by discussing your concerns directly with your counselor. You can also speak with the Site Manager or District Manager to try to fix the issue informally.

  • Contact the Client Assistance Program (CAP).
    CAP is an independent program that can help you understand your rights and support you during the appeals process. CAP will assist you in navigating mediation, hearings, legal proceedings, and your rights in the vocational rehabilitation process. Contact CAP at 1‑800‑288‑5923.
