Sushi Processing Regulations and Resources

As of January 2021, sushi kiosks located and operating within licensed food establishments are considered Retail Food Establishments. These firms can be identified as those that produce a finished, ready to eat sushi or seafood product that the consumer purchases onsite.

Kiosks that produce a seafood product that is transferred to another location, not of the same ownership, for sales or distribution are not considered retail and will remain a Wholesale Food Processor subject to Title 21 of the Code of Federal Regulations (CFR) Parts 117 and 123.

As a retailer, sushi kiosks must comply with requirements of the Michigan Modified Food Code including adhering to variance requirements detailed in the regulation. Resources to assist with compliance are provided below.
