Contract Bargaining (CB) Notice—Public or Private Sector Web Form –Both private and public sector parties are legally required to complete this form at least 60 days prior to the expiration of their collective bargaining agreement (CBA).  An FMCS Form F7 may be submitted to MERC instead.  Only one party to the agreement needs to submit this form.

Contract Bargaining Mediation Request--No form is required to request mediation in contract bargaining cases. Email MERC-Mediation@michigan.gov with the case number and a request for a MERC mediator if, and when, mediation is needed.

Grievance Mediation Petition Web Form – Submit this form pursuant to a CBA grievance process, or by mutual agreement of the parties, when a violation of the CBA is alleged.  

Grievance Arbitration Petition Web Form -Submit this form when the CBA grievance process has been unsuccessful and the parties are seeking arbitration as the final and binding step to the process. (Grievance mediation should be requested first.)

Unfair Labor Practice Web Form--Submit this form when there is an alleged violation of the Public Employment Relations Act (PERA). This applies to public sector (and private sector in limited cases where localized private employers whose operations do not cross state lines and do not meet federal volume guidelines are outside of the jurisdiction of the National Labor Relations Board (NLRB) and Act (NLRA).

Act 312 Arbitration Petition Web Form—Submit this form when the parties to a CBA involving public safety (generally police, fire, corrections, campus police) have failed to reach a tentative agreement in the bargaining process. (Collective bargaining mediation should be requested first.)

Fact Finding Petition Web Form—Submit this form when public sector but non-public safety parties to a CBA have failed to reach a tentative agreement during the bargaining process. (Collective bargaining mediation should be requested first).

Elections Proceedings Petition Web Form—Submit this form when seeking:

RC — CERTIFICATION OF REPRESENTATIVE -A majority of the employees in the proposed bargaining unit wish to be represented for purposes of collective bargaining by Petitioner, and Petitioner desires to be certified as the exclusive representative.

RD — DECERTIFICATION -A majority of the employees in the bargaining unit claim that the certified or currently recognized bargaining representative is no longer their representative. 

RM — REPRESENTATION (EMPLOYER) -One or more individuals or labor organizations have presented a claim to Petitioner to be recognized as the representative of the employees of Petitioner.

SD — SELF-DETERMINATION -Multiple units represented by the same labor organization and same employer seek to be represented in one unit. (No showing of interest required.)

UC — UNIT CLARIFICATION -Petitioner seeks clarification of the Employer's placement of a newly created (or substantially changed) position(s). (A petition for unit clarification does not raise a question concerning representation and cannot be used where an RC or RC petition is appropriate).

Verification of Majority Status Request-Public or Private Sector Web Form. Submit this form when parties are considering voluntary recognition of an employee representative and need to verify that a majority of employees want to be represented by the union.

Union Audit Web Form. This form is used by public sector labor organizations in Michigan to file an independent verification of their chargeable expenditures.
