MARSE R 340.1851 Filing a state complaint.
Rule 151.
- A state complaint filed with the office of special education of the department must meet the requirements of 34 CFR 300.153 (2019).
- An individual shall file a state complaint with the office of special education of the department within 1 year of the date of the alleged violation.
- The complainant shall deliver the state complaint to the office of special education of the department and the public agency by mail, by personal delivery, or by electronic submission.
- Any person acting on behalf of a complainant shall provide evidence of that authority to the office of special education of the department.
