Approval of Wine Bottle Sizes Pursuant to Administrative Rule R 436.1716(1)

At the January 23, 2025 meeting of the Michigan Liquor Control Commission in Lansing, Michigan.

Article IV, Section 40, of the Michigan Constitution (1963), permits the legislature to establish a Liquor Control Commission, which shall exercise complete control of the alcoholic beverage traffic within this state, including the retail sales thereof, subject to statutory limitations.  MCL 436.1201(2) provides the Commission with the sole right, power, and duty to control the alcoholic beverage traffic and traffic in other alcoholic liquor within this state, including the manufacture, importation, possession, transportation and sale thereof.

Administrative Rule R 436.1716(1) provides that wine may be bottled or sold in Michigan in containers of any size permitted by the Federal Alcohol Administration Act and approved by written order of the Commission.

On January 10, 2025, under the authority of the Federal Alcohol Administration Act, 27 USC 205(e), the federal Alcohol and Tobacco Tax and Trade Bureau (TTB) published a final rule in the Federal Register that added several new approved container sizes to the standards of fill for wine under 27 CFR 4.72.  Inclusive of the new container sizes, the standards of fill for wine approved by the TTB are as follows:

4 liters or larger, filled in quantities of even liters.

3 liters.

2.25 liters.

1.8 liters.

1.5 liters.

1 liter.

620 milliliters.

600 milliliters.

568 milliliters.

550 milliliters.

500 milliliters.

473 milliliters.

THEREFORE, IT IS ORDERED that pursuant to Administrative Rule R 436.1716(1) the Commission approves the bottle sizes for wine that may be bottled or sold in Michigan that are permitted under the federal standards of fill for wine in 27 CFR 4.72 published on January 10, 2025, as listed above.  This order supersedes any prior Administrative Order related to wine bottle sizes.
