LARA Issues Cease & Desist Order to Mount Mancelona Ski Resort in Northern Michigan

Ski lift has no permit to operate; deemed unsafe upon inspection

March 15, 2019 -  LARA’s Bureau of Construction Codes (BCC) issued a Cease & Desist order against Mount Mancelona located at 2497 Ski Run Rd., Mancelona, MI to cease and desist from operating a ski lift without a permit, in violation of the Ski Area Safety Act.  An investigation prompted by a complaint, disclosed violations of the Ski Area Safety Act: 1) not possessing a permit to operate a ski lift; and 2) a LARA inspection found the ski lift to be hazardous or unsafe.  

The Cease and Desist order prohibits Mount Mancelona from operating a ski lift without possessing a permit issued by LARA and notifies Mount Mancelona that violations of the Ski Area Safety Act may lead to administrative, civil, and criminal sanctions; that LARA will refer the matter to the local police and fire authorities, and the prosecuting attorney for review and possible action against Mount Mancelona, which may include criminal sanctions. Further, a person who violates the Ski Area Safety Act is guilty of a misdemeanor and is subject to the maximum fine allowed by law.

“Before heading out to the slopes, check with us to see if the facility has a permit to operate, said Keith Lambert, director of LARA’s Bureau of Construction Codes that oversees the state’s ski safety program. “We inspect permitted ski areas and ski lifts annually to help ensure safety. Any reports of unpermitted ski areas receive our immediate attention in order to provide safeguards for the ski community.”

Michigan's ski lifts are permitted for operation by LARA to ensure compliance with national standards and the Michigan Ski Area Safety Act of 1962. LARA’s oversight of 53 ski areas encompasses 34 surface lifts,137 chair lifts, and 125 rope tows. Michigan law requires that mechanical failures and accidents involving ski lifts be reported.
