APPLY FOR SUBSTANCE USE DISORDER LICENSE

A state licensure application is required to begin operation of a new SUD program.  To apply for a new substance use disorder (SUD) license, complete the BCHS-SUD-100.  The SUD program must identify the type of services to be offered at the licensed site by designating a specific service level category or categories outlined below:

• PREVENTION - Prevention services reduce the risk that an individual will develop problems that might require that he or she enter the substance abuse treatment system.
  • CAIT (Community Change, Alternatives, Information, Training) – Means prevention services offered by a substance use disorder services program.
• Treatment and Rehabilitation Services - Treatment and rehabilitation services will provide emergent, outpatient, intermediate, or inpatient service and care. The services offered might include diagnostic evaluation, medical, psychiatric, psychological, social service care, and referral services that may be extended to an individual who is or appears to be incapacitated.
  • SARF (Screening, Assessment, Referral, and Follow Up) – Means SUD services by offering a range of activities necessary to make preliminary assessments of problems. The object of these activities may include interviews, psychological tests, and other diagnostic or assessment tools, is to effect referrals to appropriate treatment or assistance resources if indicated.
  • Outpatient – Means SUD treatment services by offering scheduled, periodic care, including diagnosis and therapy, in a non-residential setting.
  • Medication Assisted Treatment (MAT)  – Means the use of FDA approved drugs methadone, buprenorphine, or naltrexone in combination with counseling and behavioral therapy to provide treatment of substance use disorders.
  • Residential – Means SUD treatment services that are provided in a full or partial residential setting. Such services may be supplemented with diagnostic services, counseling, vocational rehabilitation, work therapy, or other services that are judged to be valuable to clients in a therapeutic setting.
  • Residential Detoxification – Means a residential, medically acute or subacute, systematic reduction of the amount of a drug in the body, or the elimination of a drug from the body concomitant.
  • Inpatient Hospitalization – Means SUD treatment services that are provided to a person within a hospital setting under medical supervision. Inpatient care may include both emergency services and non-emergency services. Inpatient care is provided in hospitals operated by or in beds licensed by the Michigan Department of Licensing and Regulatory Affairs

If a governmental entity is directly offering SUD services, a license cannot be issued in accordance with MCL 333.6233(1), 333.1106(4), and 333.1104(7).  Governmental entities include sovereign tribes, state government agencies, local city or county agencies, and other government units.

CHANGE OF LICENSURE

A state licensure application BCHS-SUD-100 is also required to change any of the following:

• Addition or removal of services
• Name of a facility (license name/DBA name)
• Relocation (licensure fee applies)
• Change of Ownership/CHOW (licensure fee applies)
• Contact information
• Change of Program Director
• Change of Medical Director

IMPORTANT INFORMATION

The rules discussed are proposed changes and facilities must continue to follow the current administrative rules.

Effective January 1, 2021, any substance use disorder program license being held by a governmental entity will expire.  This action by the Department is being taken in accordance with the Public Health Code requirements below: 

• MCL 333.6233(1): A person not otherwise licensed to provide psychological, medical, or social services shall not establish, conduct, or maintain a substance use disorder services program unless it is licensed under this part.
• MCL 333.1106(4): Person means an individual, partnership, cooperative, association, private corporation, personal representative, receiver, trustee, assignee, or other legal entity. Person does not include a governmental entity unless specifically provided.
• MCL 333.1104(7): Governmental entity means a government, governmental subdivision or agency, or public corporation.

A governmental entity substance use disorder program can continue to operate and offer services but cannot hold or be required to hold a substance use disorder license. 

The Department has identified the following substance use disorder licenses Government Agencies Identified currently held by governmental entities.  Please contact the Department immediately if your program is not a governmental entity. 

LICENSING FEE

The cost for initiating a new SUD license and the yearly renewal cost are each $500.  SUD licenses must be renewed each year on or before July 31st.  License renewal notices and a link to the renewal website will be sent each spring to programs.  The cost for change of ownership and/or a relocation is also $500.
