Retailer Instant Rebate Coupons (Point-of-Sale)

Pursuant to MCL 436.1610d(4), a retailer may offer consumers instant rebate coupons for use with alcoholic liquor purchases.  An instant rebate coupon must comply with the following requirements:

  • A retailer shall only issue coupons that state a specific expiration date and specific cash refund value on the coupons.
  • A retailer shall not issue coupons that make any alcoholic liquor free. For spirits, the retailer shall only issue coupons where the specific cash refund amount does not exceed 35% of this state's minimum shelf price for the products purchased and does not reduce the retail price of any product below $2.00 a bottle.
  •  A retailer may issue coupons that can be applied to more than 1 specific product from a manufacturer, but must state the manufacturer to which they apply.
  • A retailer shall issue coupons that require the retail customer to purchase at least 1 product of alcoholic liquor to redeem a coupon. A retailer may issue coupons that require the retail customer to purchase 2 or more alcoholic liquor products from the same manufacturer to redeem the coupon.
  • For spirits, a retailer shall only issue coupons for the 375 milliliters or larger size bottles.
  • A supplier or wholesaler of beer or wine shall not pay for or participate in the offering of an instant rebate coupon.

 

Spirits Manufacturer or Vendor of Spirits Instant Rebate Coupons (Point-of-Sale, Spirits Only)

Pursuant to MCL 436.2029(2) and Administrative Order 2012-11, a spirits manufacturer or Vendor of Spirits (referred to hereinafter as 'Vendor') may offer instant rebate coupons directly to a retail customer for purchases of spirits products from a retailer.  An instant rebate coupon for spirits must comply with the following requirements:

  • The Vendors shall retain a Third Party Agent’s services to redeem all instant coupon transactions.
  • The Vendors shall only issue coupons that state a specific expiration date and specific cash refund value on the coupons.
  • The Vendors shall only issue coupons where the specific cash refund amount does not exceed 35% of the State of Michigan’s minimum shelf price for the products purchased. The Vendors shall not issue coupons that reduce the retail price of any product below $2.00 a bottle.
  • The Vendors may issue coupons that can be applied to more than one specific brand of their products. The coupons must state the specific brand or brands to which they apply.
  • The Vendors shall issue coupons that require the retail customer to purchase at least one bottle of distilled spirits to redeem a coupon. The Vendors may issue coupons that require the retail customer to purchase two or more bottles of distilled spirits to redeem the coupon.
  • The Vendors shall only issue coupons for 375 ml or larger size bottles.
  • The Vendors shall not issue a coupon unless the coupon states that its value cannot be doubled or increased in any manner by the Specially Designated Distributor Retail (SDD) Licensee.
  • The Vendor shall make every instant coupon available to all SDD Licensees that choose to offer the instant coupon, in an amount no greater than the retail licensee’s inventory of the specific spirit product that is subject to the instant coupon promotion.
  • The Vendor shall not distribute coupons or cash refund point of sale material that states the name of an SDD Licensee, in accordance with the provisions of administrative rule R436.1319(3). SDD Licensees may display cash refund point of sale material. The Vendors shall not provide any fee or other consideration to the SDD Licensee for displaying coupons or point of sale material.

Supplier or Manufacturer Electronic Rebate Coupons

Pursuant to MCL 436.1609h, a supplier or manufacturer may offer electronic rebate coupons directly to a retail customer after the retail customer purchases the alcoholic liquor from a retailer.  An electronic rebate coupon must comply with the following requirements:

  • A manufacturer or supplier shall only issue coupons that state a specific expiration date and specific cash refund value on the coupons. The refund may be paid by cash, by check, by debit card, through electronic funds transfer to a bank account, or through an internet or mobile payment account.
  • A manufacturer or supplier shall not issue coupons that make any alcoholic liquor free.
  • A manufacturer or supplier may issue coupons that can be applied to more than 1 specific product sold by that manufacturer or supplier but must state the manufacturer or supplier to which they apply.
  • A manufacturer or supplier shall issue coupons that require the retail customer to purchase at least 1 product of alcoholic liquor to redeem a coupon.
  • A manufacturer or supplier may issue coupons that require the retail customer to purchase 2 or more alcoholic liquor products from the same manufacturer or supplier to redeem the coupon.
  • A manufacturer or supplier may issue coupons that require the purchase of a product other than alcoholic liquor.
  • A wholesaler shall not pay for or participate in the offering of coupons except for providing signs that promote the electronic rebate coupon in accordance with section 610a.
  • A manufacturer shall only issue coupons that may be redeemable after a purchase of alcoholic liquor at all retail locations where that alcoholic liquor is sold.

Supplier or Manufacturer Mail-In Rebate Coupons

Pursuant to Administrative Order 2026-01, a supplier or manufacturer may offer mail-in rebate coupons directly to a retail customer after the retail customer purchases the alcoholic liquor from a retailer.  An mail-in rebate coupon must comply with the following requirements:

  • A manufacturer or supplier shall only issue coupons that state a specific expiration date and specific cash refund value on the coupons. The refund may be paid by cash, by check, by debit card, through electronic funds transfer (EFT) to a bank account, or through an internet or mobile payment account.
  • A refund shall not be made by the manufacturer or supplier to the retail customer unless proof of purchase is submitted by the retail customer with the coupon.  An acceptable proof of purchase is a cash register receipt or other receipt issued by a retailer licensee.  A product label or Universal Product Code (UPC) code from the package or container may be required by the manufacturer or supplier to be submitted by the retail customer, but a product label or UPC code by itself is not acceptable as proof of purchase.
  • A manufacturer or supplier shall not issue coupons that make any alcoholic liquor free.
  • A manufacturer or supplier may issue coupons that can be applied to more than 1 specific product sold by that manufacturer or supplier but must state the manufacturer or supplier to which they apply.
  • A manufacturer or supplier shall issue coupons that require the retail customer to purchase at least 1 product of alcoholic liquor to redeem a coupon. A manufacturer or supplier may issue coupons that require the retail customer to purchase 2 or more alcoholic liquor products from the same manufacturer or supplier to redeem the coupon.
  • A manufacturer or supplier may issue coupons that require the purchase of a product other than alcoholic liquor.
  • A Wholesaler licensee shall not pay for or participate in the offering of coupons except for providing signs that promote a mail-in rebate coupon in accordance with MCL 436.1610a.
  • A manufacturer shall only issue coupons that may be redeemable after a purchase of alcoholic liquor at all licensed retailer locations where that alcoholic liquor is sold.
