Wine MSD Price Posting

Wine & Mixed Spirit Drink Price Filing Pursuant to MCL 436.1609a (Post and Hold)

A manufacturer or wholesaler shall:

  • File with the Commission a schedule of net cash prices to retailer licensees for all brands of wine or mixed spirit drink products for its market area. (Prices for new products and package sizes must be filed with the Commission prior to sale to retailers.
  • File with the Commission a wine or mixed spirit drink package price reduction for its market area. The manufacturer or wholesaler shall file the price reduction before its effective date. A price reduction must continue for at least two (2) weeks after the effective date.

A manufacturer or wholesaler shall not charge a retailer a fee in addition to the net cash prices filed under this section, except for a split case fee.

  • If a manufacturer or wholesaler charges a split case fee to a retailer, the fee must be at the same per unit rate, nondiscriminatory, and not be based on a sliding scale. A manufacturer or wholesaler shall file with the commission a split case fee.

A manufacturer or wholesaler shall not sell wine or mixed spirit drink at a quantity discount.

Wine or Mixed Spirit Drink Price Posting Submissions

Wine and mixed spirit drink price filings do not require Commission approval as long as the licensee complies with all provisions of the Michigan Liquor Control Code and administrative rules.

There is no required form for filing a wine or mixed spirit drink price schedule. Please include the company name, brand, package size, and per case price to retailers.
